Yeah, I don't think so.
If you go pawn it then maybe you could call it theft.
Do they have a warning "DO NOT REMOVE UNDER PENALTY OF LAW"?
How the hell is anyone going to know it's a PO PO device anyway?

Good point Para. I simply posted the video as the case was presented. I think it raises an interesting question though from a pure legal perspective.

However, given the guy in this particular case did have drugs he would likely know why it was there. Or he could have thought an ex or angry drug dealer put it there. Who knows. Even though the guy is a scum bag I’d have a hard time convicting him for theft. I think.

jljones will have to back that up with court cases. Yup the courts say you can't add one without a judge since its a search. But removing one you have no knowledge of the owner and purpose, you simply are not going to lose in court.

Apparently the Indiana Supreme Court hasn’t ruled that that is the case - in Indiana. If it isn’t marked, how would you know who it belongs to, or what it is for that matter?


Pretty simple.

Call the police. Report a “device” that you have located on your vehicle.

Laugh when they pull it off of your vehicle. Keeps you from catching a charge in the event that it is police.

I’m also pretty sure there are SCOTUS cases that require a court order. Signed by a circuit court judge.

IF i found a device on my truck, even if it was marked property of police whatever, it is coming off. And the battery is coming out.
It will sit on the workbench in the garage until they knock on my door asking me if I have seen it when I will smile politely and return it to them.

A court approval for the police to place a surveillance device on my truck is not a court order for me to leave it on my truck and removing it from my own property being theft is bullshit.

I have a nice anvil out in the garage I bought years ago. I also have a 30# sledge hammer out there. Mating the pair with the unknown device inbetween might be fun. After one or two solid hits, it will stop transmitting.

It takes a tremendous amount of PC to put a tracker on a vehicle. If you find a police tracker on your vehicle, someone didn’t do their job properly. Ive been doing this for more than two decades and can count on one hand how many times I’ve even HEARD of it being done (not counting police vehicles). Hell, we don’t even have to do it on company cars anymore. The car itself, the computer, the radios, the in car video, and the body cams are all gps enabled.

Besides, who needs trackers. Everyone carries around their own gps tracking device in their pockets these days. I don’t worry so much about what law enforcement does, I worry about what private industry does with all that location information they collect...

Some random thread drift that occurred to me...

Here in CO your automobile is considered an "Extension of your home". I know this specifically because it's related to firearms. Here in CO you do not need a CCW/permit/whatever to have a concealed handgun in your car. If you are legally allowed to posses a handgun, you can carry it in your vehicle without government permission (permit) and you are not breaking the law.

I realize these are state specific laws, just wondering how the opinions would change since the police are attaching something to "an extension of your home". Maybe nothing changes, just curious.

A court order is still going to be a court order. Just the same if it was to wire tap your house.

Para they are very common. Typically they are used to track someone who they believe is dealing drugs. At least on the state level.
