Knowing only what I’ve read over the past couple of weeks, I hope that Fiji prevails.
She signed her contract, became surprisingly more recognizable (let’s go easy on the word, famous) and let someone get into her head and fuck it up.
A smarter agent would have figured out how to leverage this into a long term campaign with Fiji. Too bad for her.

c1steveThe article states that the model has the only signed copy of the agreement. If that is true, it complicates things. Still, she got greedy and this may haunt her for many years.

comet24She should have leveraged the attention to other areas with other companies.
After this suit, I wouldn't hire her for any kind of job. She had a contract and wanted more. I don't fault her for trying to renegotiate her contract but when Fiji said no she should have moved on.
I bet she thought they would roll over and pay her.

sigcrazy7Why does having only one copy complicate things? Won't the plaintiff need to provide a copy to the defendant during discovery? Or is the problem a chain of custody kind of thing, where the authenticity of the contract can be disputed if only one side had a copy?

LS1 GTOMy stepdaughter did some modeling a few years back (she's very beautiful but couldn't handle being the center of attention) and brought me her first, and only contract. The one year clause, and full rights to her image are industry standards (took me less than 30 minutes on Google and a couple phone calls to verify). We still, occasionally, she her picture pop up the years later.
Now true story; her father ("they won't put me in jail for that" type) decided he wanted to photograph his daughter and post said pics on his website to promote his business - two months before her contract legally ended. She came to me first and asked and I said she couldn't do it unless her father went through her agency. Needless to say, her father said I was full of it and the agency would not care since she wasn't getting paid and it was for her father (both were specified no-no in the contract). She tells her father to wait two months. When time is up she says "let's do it" to which he replied "sorry, already paid someone because the market..."

TigerDoreShe was paid $90,000 for about 2-3 hours of work. That's a really nice payday for someone whose only apparent talent is her looks. I don't think even neurosurgeons' pay rate would touch $30k-$45k per hour.
She's dumb. She could have possibly parlayed that into more things. Now that she is known as someone who will sue for no apparent good reason, she's too toxic to hire.

90k for three appearances and one year under contract. And the two to three hours of work per event includes being nice to some pretty rude and crude assholes hitting on her (every 10 minutes at this type event) plus never being out of character when someone "famous" starts talking to you. Don't forget being there a couple hours early for prep and the travel. Unless you go with someone (or escort in my case) doing a job, it's hard to appreciate (I had some pretty nasty insults directed my way just for being near my daughter and keeping/ scaring the vultures away).
Those three appearances (two after the Golden Globes) likely would've included the Emmys and Oscars them nothing for the remainder of the year unless Fiji decided to send her to Cannes, sporting events, etc for the additional 20% per event (without reading the full contract this is a SWAG).
She had the opportunity to spin this into a very lucrative deal for the next year and then find herself a good agent.

Reminds me of the story I read about Roger C Carmel. (Harry Mudd of Star Trek fame).
Seems he was in a show called Mothers in Law with Eve Arden and Kaye Ballard. The show wasn’t doing too good and was eventually picked up for its second season. No money allotted above the first seasons limits. Even tho the cast’s contracts called for a raise in the second year there was no money. Everybody but Carmel agreed to the second year. He was let go by Desi Arnaz. The new guy who replaced him didn’t cut the mustard. The whole show was cancelled after the second year.
Carmel’s career went into the crapper soon after. He was probably branded a malcontent. Word got around fast.
