Earlier this year, a semi ahead of me on I-64 dropped something that bounced under my Corolla and knocked a fist sized hole in my oil pan. Insurance covered the damage (except deductible) but LE just filed a report. I did press the insurance company a bit as I had the truck info, but the just called the trucking company, who said all their trucks reported no damage. It could have been much worse. As an aside, I now drive a truck, almost twice the size and weight of the compact. | |||

Driving to Tampa on Eye-Four, the worst dang road in FL, traffic came to a crawl, eventually we passed what was left of a very large BBQ smoker that had detached from a pickup. Pickup was on the side of the road, smoker was in middle lane, as big and heavy as it was damage would have been big time. | |||

Aren’t sometimes accidents just that, accidents? Must somebody always go to jail? In your story, who should go to jail? Suppose the truck driver took his truck to T/A, Speedco, or the Dealer for service. If they missed a U-joint with the grease gun, should the cops roll up and arrest the grease jockey? The company and driver were doing what was required, taking the equipment in for service. If a part was defective, should someone at Spicer or Eaton go to jail? Maybe some peasant in China or Mexico? Sometimes accidents are just accidents. Anything made by the hand of man can fail. There’s an inherent risk to leaving your house, and that risk isn’t all criminal in nature.
