New York Official suing state for ruining sex life
NEW YORK CITY — An official in New York is suing the state for ruining her sex life.
Assemblywoman Michele Titus claims she has not had sex with her husband ever since he got fired three years ago.
Titus and her husband, Eric DeBerry, filed the lawsuit in August and accused the New York State Unified Court System of wrongful termination and discriminating against black workers, the New York Daily News reports.
Her husband was a court officer until he was fired for cursing out a civilian.
Their lawsuit said that after his firing, his wife didn’t want to be with him since he was always agitated, short tempered, and defensive.
The state has not commented.

Easy defense, he was clearly agitated and short-tempered before he was fired as evidenced by him cursing out the civilian. I should be a lawyer!

What evidence can she produce that they have not had sex?
She doesn't state that she hasn't had sex with anyone else, just not her husband. Maybe that photo, above was post-sex. How would we know otherwise?

The state has several defenses available that will make the suit difficult to win:
It is the state. States are generally immune from suit except on subjects where they consent to be sued. If he has a contract (unionized?) he may have an employment contract that allows a suit or administrative remedy, but it would be hard to imagine it reaches a claim like interference with consortium. An employee is protected by anti-discrimination federal (and state law), but this guy seems to have been fired for a proper reason, so that shouldn't come into play.
That loss of consortium claim is attenuated from the firing and it may be hard to make a causal link between the firing and the lack of sex. The harm (no sex) may be hard to link to the alleged bad act (the firing). (Their testimony is perfectly good evidence that they haven't had sex. The jury would hear their testimony and decide if they are believable. They wouldn't need photos of them never having sex, which couldn't exist anyway.) It isn't like a physical injury where causation can be established.
This claim seems to be a long stretch, unless there are facts not disclosed, which is certainly possible.
