A man was fatally shot while he reportedly was burglarizing a Leavenworth home, a police official said.

The shooting was reported at 1:15 a.m. Saturday at 604 Chestnut St.

A 74-year-old woman reported to police that she had shot a burglary suspect at her home with a handgun, according to Leavenworth Police Chief Pat Kitchens.

Officers responded to the residence and found the burglary suspect, Ralph Byrd Jr., 41, Leavenworth, inside the residence with a gunshot wound.

Leavenworth County EMS personnel also responded, and Byrd was pronounced dead at the scene.

“Very briefly after the officers began the investigation, the 74-year-old woman suffered a medical event,” Kitchens said.

The woman was taken to the hospital. Kitchens said the woman is expected to survive.

The investigation of the shooting is ongoing.

“It’s being classified as an aggravated burglary and homicide investigation,” Kitchens said.

Kitchens said the focus of the investigation concerns the report that the person who was killed was committing a burglary.

He said police will meet with representatives from the County Attorney’s Office at some point to present the facts of the case.

I don't know what Kansas law says regarding use of deadly force to stop a burglary, but I hope she doesn't wind up facing any charges.

Kansas is "defense" (SYG/CD) friendly.

You can use deadly force under most forcible felonies, attacks against your person, breaching your home/conveyance and such.

And in the defense of others if the person you are defending would be covered under the law for their own defense.

Similar to Florida.

I would assume it is. Its a pretty small town.

As expected, the lady will not be charged. She has been released from the hospital, and seems to be doing OK. Also, the updated story indicates she shot the bad guy in the head once with a .22.

The county attorney said he is not seeking charges against a Leavenworth woman who fatally shot a burglar.

The shooting occurred early Saturday morning at 604 Chestnut St. A 74-year-old woman reportedly shot Ralph Byrd Jr., who was pronounced dead at the scene.

County Attorney Todd Thompson said Thursday that state law recognizes a person may have a reasonable belief that deadly force is necessary for self defense in the case of a break-in.

Thompson said the woman fired only one shot from a .22 caliber handgun.

“She hit the man in the head,” Thompson said during a news conference.

Thompson said the woman apparently had obtained the firearm about a week before the shooting because of an earlier attempted break-in at her residence.

The woman suffered a heart attack Saturday following the shooting. But Thompson said the woman has been released from the hospital and he believes she is doing OK.

On the night of the shooting, the woman called 911 to report the break-in. She was still on the line with dispatchers when the shooting occurred.

“She was home alone at the time,” Thompson said.

The woman fired the shot after she confronted Byrd at the top of stairs.

Thompson said he believes Byrd had been acting alone when he forced entry into the home.

Even though the woman’s actions are considered justified, Thompson said it had been important for the Leavenworth Police Department to complete an investigation of the incident.

Leavenworth Police Chief Pat Kitchens was present Thursday for Thompson’s announcement.

“I think it was an appropriate decision,” Kitchens said after the news conference.

According to a Kansas Department of Corrections website, Byrd was convicted in March of burglary and drug charges. The crimes occurred in December 2017.

According to the website, he absconded from his probation supervision in July.
