Once again, a homicidal human piece of bellybutton lint went on a murder spree at a club in California. You already know what this means: anti-gun Twitter rants. Unable to resist the temptation to act like a grandstanding jagweed, Ashton Kutcher got in on the action. “Something, something, guns are bad, m’kay.”

Yeah, there’s just one teeny little problem:
Generally, it is illegal for any person who is not a California licensed firearms dealer (private party) to sell or transfer a firearm to another non-licensed person (private party) unless the sale or transfer is completed through a licensed California firearms dealer . A “Private Party Transfer” (PPT) can be conducted at any licensed California firearms dealership . The buyer and seller must complete the required DROS document in person at the licensed firearms dealership and deliver the firearm to the dealer who will retain possession of the firearm during the mandatory 10-day waiting period .
Unless I’m missing something, it looks like Captain Gun Grabber here is illegally in possession of a firearm.
California already has some of the harshest anti-gat laws in the country. Something Kelso might be about to learn the hard way. African American rifles of color are a no-no. Owning a high-magazine mega clip is out of the question. Pretty much every “common sense” gun law the left wants is already in place in the Golden State. That includes not trading boomsticks in parking lots, Ashton.
This might be the best example ever of how leftist anti-gunners know zilch about gun laws. Ashton Kutcher fancies himself an authority on firearm legislation. Yet, he hasn’t got the first clue about gun statutes in his own state. This is why we refuse to take lefties seriously on matters of boomstickery, no matter how “common sense” they claim their stances are.

It seems to me that many of these people claim to own guns as a way of enhancing their credibility when challenged with, “How can you criticize guns and their owners when you don’t know anything about them?” “I own a gun, but I’m not deranged enough to actually want to shoot it.” And claiming to own an illegal gun isn’t illegal anywhere in the U.S. I know of. The most the police could do would be to ask, “Do you own a gun?” (and even that’s unlikely) and when he says, “No I don’t, actually,” then they would say, “Well, don’t.”

Wouldn’t stating in writing that you possess an illegal firearm be probable cause for the police to obtain a search warrant of your home?
People say and write stupid things all the time. (There is an entire industry around it.) So I don’t know if it’s enough.

Anything is possible, of course, but one thing that’s usually a requirement is specifying the location to be searched, and that must be supported by the information available. If the guy said that he keeps the gun in his office safe, that would be one thing, but just saying he has one without indicating where it might be would not normally support a warrant to search everywhere it might be located.
There’s plenty to not like about people like this claiming to own guns illegally, but I personally would like it even less if the police could get a warrant to search everything I own on the basis of a stupid statement. There are obvious exceptions such as threats against high officials, but those exceptions are already violations of the law in themselves.

No. Not even close. He writes he has a "gun". Is it a pistol, rifle or shotgun. If a rifle, is it a bolt hunting rifle, or a semi-auto regulated under the 1989 act. He says it was given to him at the borderline. Is it the Borderline in Thousand Oaks where the shooting was or a borderline in another state?
Also, as Sigfreund points out, there is no specificity as to the location of the potential gun. Is it in his house? Does he own more than one house?
He was born in, and went to college in Iowa. Is there a Borderline in Iowa and did he get the gun there?
Without the answer to questions like these, including the threshold question of whether the gun in question is in fact illegally obtained, there is no PC for a warrant.

This could be resolved much easier than via a warrant anyway. Ole Ashton advertised publicly on Twitter he has what appears to be an illegal gun. Have the Sheriff of the area Kutcher lives in very publicly ask Kutcher to bring the gun in for evaluation. How could Kutcher refuse after his tweet? So, if Kutcher is stupid enough to comply (and I believe he is), the serial number on the gun could be run and Id'd as legally or illegally owned. If illegally owned, hook him up and prosecute. If legally owned, no harm no foul. If Kutcher can't produce the gun (which I suspect is the truth), then he's publicly outed as a liar. Case closed.
