The 2nd Circuit overrules the Southern District of New York which held that withholding of law enforcement grant funds was unlawful. Massachusetts, Connecticut, New Jersey, New York, Rhode Island, Virginia, Washington, and NYC can collectively suck it. I do feel bad for the officers who will be denied federal grants to do their jobs. Article here. Opinion here. I doubt it. This is pretty inside baseball stuff. It isn't about all federal money going to the state, it is about a particular form of law enforcement grant that is made to the state, and which the AG (at the time, Sessions) conditioned on cooperation with federal immigration enforcement efforts. As such, while this is a nice win, where logic finally prevailed over emotion, and "fuck the Trump administration" in the judiciary, it's not big money, nor will it drive the population into the street to protest the horrible loss of federal support for the children, etc., etc. "I vowed to myself to fight against evil more completely and more wholeheartedly than I ever did before. . . . agreed with Artie but a win is a win and it sort of makes the case that the states are simply not entitled to federal funds to use in violation of federal law now if we can get two more judges on the 9th and then hear a gun control case, life would be grand [B] Against ALL enemies, foreign and DOMESTIC | |||

Trump has already filled 51 vacancies on U.S. Courts of Appeals, the “circuits” that provide much of the guidance federal trial judges utilize. His appointees now represent more than one-fourth of appeals-court judges, and he has succeeded in “flipping” three of the 13 circuits from Democratic-appointed majorities to Republican-appointed majorities.
