16 Marines Arrested for Alleged Human Smuggling, Drug-Related Offenses

During an infantry battalion’s morning formation on Thursday at Camp Pendleton, Calif., 16 Marines were arrested on allegations they took part in illegal human smuggling and illicit drug-related offenses, 1st Marine Division announced.

Another eight Marines with the battalion “were taken aside to be questioned on their involvement in alleged drug offenses related to today’s arrests,” division officials said in a news release.

An official confirmed to USNI News the Marines arrested and questioned are all assigned to 1st Battalion, 5th Marines, an infantry battalion in Camp San Mateo at the Southern California base.

“The investigation is ongoing. They were taken into custody by NCIS personnel,” said a division spokesman, 1st Lt. Cameron Edinburgh. Charges against each of the Marines were pending and no information yet was available.

Division officials said today’s arrests and investigation are tied to “information gained from a previous human smuggling investigation.”

That case appears to be the July 3 arrests of two Marines – Lance Cpls. Byron Daniel Law II and David Javier Salazar-Quintero, assigned to 1st Battalion, 5th Marines. The Marines were stopped in the Boulevard/Jacumba area, east of San Diego, by border agents who had spotted a black car in an area known for smuggling and where agents saw fresh footprints, according to the federal complaint.

Another agent spotted the car and pulled the vehicle over. Law was driving and Salazar-Quintero was in the front passenger seat.

Three men in the back seat told agents “they are citizens of Mexico without any immigration documents that would allow them to enter or remain in the United States legally,” the complaint stated. All five men were arrested.

“Law claimed that (Salazar-Quintero) was the individual responsible for organizing the event” and solicited Law’s involvement, hours earlier, “picking up an illegal alien” in return for $1,000, the complaint stated. Law said the two Marines had picked up that individual in Law’s black BMW and dropped him off at a McDonald’s in Del Mar, a coastal city in northern San Diego, then returned to Camp Pendleton.

Both Marines returned to the border area the following morning after Salazar-Quintero called Law “for another job” and promised payment for both, the complaint states. They picked up the three men along Interstate 8 before agents pulled them over and arrested them. Two of the men told investigators “they were going to pay $8,000 USD to be smuggled into the United States,” destined for New Jersey and Los Angeles.

According to the complaint, Salazar-Quintero “admitted coming to Jacumba to pick up on four different occasions.

Both Marines pleaded not guilty at their July 17 arraignment in U.S. District Court in San Diego and were released on $10,000 bonds, according to court records. Both are required to submit to drug testing, according to court records. A motions hearing is scheduled for Aug. 5.

In the release, division officials said “1st Marine Division is committed to justice and the rule of law, and we will continue to fully cooperate with NCIS on this matter. Any Marines found to be in connection with these alleged activities will be questioned and handled accordingly with respect to due process.”

PENDLETON

Camp Pendleton, Calif. – On the morning of July 25, 2019, officials from 1st Marine Division worked alongside the Naval Criminal Investigative Service (NCIS) to carry out the arrest of 16 Marines during a Battalion formation at Camp Pendleton, California.
The 16 Marines were arrested for alleged involvement in various illegal activities ranging from human smuggling to drug-related offenses. Information gained from a previous human smuggling investigation precipitated the arrests.

An additional 8 Marines were taken aside to be questioned on their involvement in alleged drug offenses unrelated to today’s arrests.
None of the Marines arrested or detained for questioning served in support of the Southwest Border Support mission.

1st Marine Division is committed to justice and the rule of law, and we will continue to fully cooperate with NCIS on this matter. Any Marines found to be in connection with these alleged
activities will be questioned and handled accordingly with respect to due process.

The Marines - all E-2 to E-4 in rank - were arrested based on information gained from a previous human smuggling investigation, military officials said.

A Navy E4 from Naval Base San Diego was arrested on the 23rd for the same thing. That didn't make the news though.

That many guys from a single formation....young guys like that can't keep their mouths shut, especially when somebody has an 'alternative revenue stream'. There's got to be a few more stripes that knew or, were-in on it, sounds like NCIS is building a massive case. Would be interesting if there's similar investigations in Arizona around Luke AFB and Yuma.

3 Service Members Arrested in Connection with 'Mass Arrest' at Camp Pendleton

Three additional service members have been arrested in connection to an NCIS investigation into allegations of human smuggling and drug-related offenses.

An NCIS spokesperson said a Navy sailor was arrested Thursday in addition to two other Marines.

It brings the total number of arrests to 19, including 16 Marines arrested Thursday during a morning battalion formation at Camp Pendleton. The arrests were made in the presence of 800 Marines during that formation.

“Certainly that’s going to send a message. And if you put those individuals in the brig, you continue to make it clear to other junior Marines that this type of behavior is unacceptable,” said Marine officer and former JAG Robert Muth. Muth is currently a law professor at USD.

As of now, none of the 19 arrested service members have been charged.

In a statement, NCIS spokesperson Jeff Houston said no further information is available and updates will be provided when they become available.

“Out of respect for the investigative and judicial process, and to protect witnesses, NCIS will not comment further until the investigative and judicial process has completed,” the statement concluded.

The Marine Corps also did not provide any specific updates but released a two-part statement.

“The Marines who were detained [Thursday] have not been charged. We will provide updates once new information becomes available. Out of respect

for the privacy of the implicated Marines, we will not release names or other identifying information until charges are announced.”

The statement also added:

“The Commanding Officer of 1st Battalion, 5th Marine Regiment will act within his authority to hold the Marines accountable at the appropriate level, should they be charged.”

The arrests of the 19 service members comes after the July 3 arrest of two Marines who have been charged with trying to smuggle migrants into the U.S. from Mexico. The pair has pleaded not guilty.

It’s not clear how those two Marines, if at all, implicated the other 19 service members.

“Once they were arrested, presumably their cell phones and other evidence would have been taken from them. And based on what might be on the cell phones, the government may have been able to further unravel the broader plot as to what was going on here,” said Muth.

Muth also said it’s possible we may not learn of any specific charges for at least a week.

Junior military folks with way-too-expensive cars (for their pay grade) are nothing new. It can be a sign of 'unexplained affluence,' but not always. I knew a junior NCO that drove a really expensive car - but his wife was a surgeon.

We have briefings to be on the lookout for people that unexplainably come into money (especially if they have high security clearances). It can be a sign of espionage or other criminal activity. . .

As for these dirtbags; give them a fair trial, and if convicted, lock them up and throw away the key.

My son is at Pendleton. We talked about this story a few days ago. He mentioned several court martials regarding meth labs in barracks, and other events that have occurred, and said the 16 recent arrests didn't surprise him much.

Really a nonsensical question as we in this country are all afforded due process, but since some people don't understand that it is inferred....Yes, always a fair trial first, but once found guilty, nail their asses.

Make an example for all to see that the easy way to making cash may not be the best way to make cash. The military isn't exempt from shitheels. Gang members are a big concern right now and they are getting more sophisticated in terms of what they are doing and who is involved. Drug running schemes have been around a long time. Adding people to the mix shouldn't surprise anyone.
