Class B = Maximum sentence of 10 years. (Class A would have a max sentence of 20 years) A lot of this bill is anti-gunner pipe dreams--like registering magazines. How is that even possible? Even if it passes, there are big Constitutional issues. Or. State Shooting Ass'n v. Multnomah Cty., 122 Or. App. 540, 858 P.2d 1315 (1993), in which the OR Court of Appeals said it was ok to ban "Assault Weapons" was decided before District of Columbia v. Heller, 554 U.S. 570, 128 S. Ct. 2783 (2008). The 1993 state case was decided on grounds diametrically opposite to the US Supreme Court's holding in Heller (In Heller, the Supreme Court ruled that the RKBA applied to modern weapons, not simply late 18th century muskets; in the 1993 state ruling, the OR Court of Appeals believed that OR's RKBA was bound to mid-18th century weapons present at the time the OR Constitution was ratified). Ironically, the OR Appeals Court decision references some Supreme Court decision (which doesn't seem to have a citation) that RKBA only protects weapons available at the time the OR Constitution came into effect. If their reference is to the US Supreme Court, then that reasoning has been explicitly overruled. | |||
