No More Mr. Nice Guy |
Ok, I'll condense my responses. First of all, this law does not say a business cannot prohibit lawful concealed carry, it says that a business which does so is taking on legal liability for injuries caused by violent crimes. Just like my example of the ski resort prohibiting winter footwear. If they mandate I must wear slippery soled shoes then they take on responsibility to make sure there is no snow or ice or other slippery stuff on their property. As far as meteors that is getting ridiculous, no? Bee stings? Well if the gas station knows there are bee hives around which they do not remove and the bees sometimes enter their building, and they prohibit patrons from wearing clothing, then they would seem to accept liability for bee stings. But what if it is just normal conditions but they put up a sign saying "No protecting yourself in case a bee tries to sting you"? Wouldn't they then have a higher responsibility to ensure no bees are present? Scoliosis? Really? Car accident in the parking lot? Does Home Depot prohibit me wearing my seatbelt? Must I disable my horn and airbags? Do they prohibit the use of turn signals? Nope, but they do spend gobs of money on designing the lot, painting lines, and putting up signage. What exactly does my local store do to prevent a violent offender from committing crimes there? No metal detectors, no pat downs, no searching bags, no vehicle checkpoints. Nothing. As you say, the only person responsible for my safety is ME, so if the business takes away that ability then they are implicitly taking on that responsibility themselves. That's all this law does. A business can allow lawful concealed carry, or they can prohibit it but then they become legally liable for injury from violent crimes.

If they openly allow you to carry a firearm, then what is their liability when you accidentally shoot one of their other customers? See, now that they have explicitly told you that you can carry a gun there, then they have now knowingly introduced a risk that they're aware of. So how do they now mitigate that risk to protect the other customers?

Some things are better left unsaid. Let’s face it, a criminal that is willing to commit armed robbery or other related offenses is not going to worry about an owner and their silly and unenforceable sign. ___________________________ Avoid buying ChiCom/CCP products whenever possible.

That's the beauty of the current system. Businesses can post signs which gives them some level of protection when it comes to liability. Gun owners can ignore signs which gives them the ability to defend themselves. Criminals will ignore the signs, so nothing changes there. There's nothing wrong with the way things are, and it seems some people are hell bent on "fixing" things until they're even more broken.

I suspect this bill was the work of a virtue signaler that wasn’t smart enough to realize how his actions could play out in the real world. ___________________________ Avoid buying ChiCom/CCP products whenever possible.
