Well he started taking pictures of my son and two little girls (all under 10) while driving slowly down the street. Now I'm officially involved instead of being the neighbor that was watching from the sidelines telling everyone what they should do. I'm off the leash now.
Filed my police report along with another parent who's kid was there too. Deputy came out again and had a more stern talk with the guy and the guy said he wasn't breaking any laws. The deputy wasn't too amused with that response.
I managed to get the landlord's phone number and talked with him yesterday. I just emailed him photos of his tenant taking pictures the wives a month ago (photo taken by the wives).
We dug deeper into the HOA bylaws and found the section that deals with harassing behavior by tenants and the HOA is putting the landlord on notice and will begin fining him from now on for every further infraction.
Also cited to the landlord the 24 hour termination rule that was posted earlier in this thread for outrageous behavior.
I asked him for the tenants names, but I don't know if he'll give that up. If not, I wonder if I can get it from the police report. We want to do a social media check on the guy.
I told the landlord that all of us are creeped out wondering what a 20-something year old guy is doing with our kids' photos. I told him this guy is setting off all sorts of red flags and will he wait until one of the children gets hurt before he acts? I basically told him this guy fits the profile of a school shooter and that we live right behind a school. Does he want to be responsible for that?
He wants to try and arrange a meeting between the tenants and all the parents to possibly have a civil talk. I'd love to do that!
Wow, I don’t know what to say. I can’t imagine dealing with that and not just dragging the kid out to the woods for a good beating.
I wish the best for you and hopefully the landlord evicts them soon.

I'm sure your HOA has a lawyer that has been used in the past. I'd certainly have them draft a formal letter that puts the landlord on notice and holds him responsible for the actions of his tenants. This would certainly grab his attention. Just a thought to move this along quickly.

Our HOA (very relaxed) has a clause in the bylaws prohibiting an owner from subletting to others. Sounds like you need to bring it up as an amendment at the next HOA meeting.

Yep, that would definitely be a two gun carry meeting for me along with one of those body armor backpacks.....and a bomb detection dog.......and the wife would have a big freaking purse.

Arrange a meeting with the residents and this nut and his family? How does the landlord think that will go? If I were in his shoes, I would be taking any action I could to cut these people out of my life and property. This reinforces my thoughts from my original post: The landlord has some kind of deeper connection to the tenants. My guess is they are family.

Money talks. HOA fines for every HOA rule that is broken. A constant stream of HOA fines to the landlord will get his attention FAST!

Could be that or maybe the guy has threatened the landlord - he mouthed off to the police, so the landlord may be scared of what he will do if he tries to evict him.

I am dealing with this very issue right now with a tenant who moved into my 4 plex January 3rd. On paper he looked perfect, single white guy in his early 60's,very personable and polite, no criminal record, full disability with a $2300 a month check. Now getting complaints from several neighbors and tenants, saying he is a crackhead and the week he gets his check is party city, with people coming and going and his "guests" selling drugs in the street in front of my property.
After speaking to a lawyer, I cannot evict him for being a nuisance without a written police report from someone calling the police and making a report against him. I did give him the 7 day FL notice to comply (which he's deathly afraid of me throwing him out and called me with a spiel that it was his caretaker and apologizing and blah blah blah). But a lawyer told me it won't stick (the eviction) unless there's a police report, otherwise it's heresay and given his age and disability the court will throw out the eviction. I will NOT be renewing his lease on January 2nd, but that's a very long road to tow for my other tenants and the neighbors and the first real opportunity I get to throw him out legally and I will. But sometimes, you just can't until you have proof that will hold up in court.

That thought had occurred to me as I was taking a break for some outdoor chores.
I was going to ask when I got back online if the landlord was from a different country or culture. A friend of mine had similar, but not as severe, experiences as what you're going through. The renters were Caucasian, the landlord was from Pakistan. Cars on blocks in the driveway & yard, poor upkeep of house and yard, etc., and no HOA.
Eventually the landlord sold the home to owners who actually lived in the house and took care of their vested interest.

In my experience, folks of Indian descent are pretty responsible with their money. However, if the landlord just doesn't GAF or is into some kind of real estate or mortgage shenanigans, HOA fines won't matter to him. What the worst the HOA can do? Impose lots of fines that go unpaid and then put lien on the house? Landlord may not care, may view it all as a business expense and tax write-off. HOA can't evict.

Here's your solution. Hit the ATM for a couple hundred bucks and then head to the hood. Find a couple of enterprising young men seeking to "turn their lives around", hand them the cash and addresses of the landlord and renters, and one simple direction....hospital, not morgue. Problem should be solved in a manner of hours.
