I had my bank err in my favor a couple of years ago, I immediately contacted them and let them know about it. The woman that I spoke to was very impressed with me and complimented me on my honesty, I replied “What else would I have done, it wasn’t my money to keep.” She also mentioned that they would’ve discovered the error rather quickly on their own. This happened to me back in the mid-80's, I deposited a paycheck, not much, but they continued to deposit the same amount daily for a couple weeks. I didn't even know it, the bank just took the money back out, only reason I even knew it happened was when I got my checking statement. | |||

It would depend on state law, but in Texas, a civil judgment will always have post-judgment interest, and a plaintiff may be able to be awarded pre-judgment interest on some claims. I don't think the bank could claim ANY interest they earned, but perhaps a claim for the earnings the bank didn't earn might be a valid claim, depending on the facts. But, lost profits are a claim that can be hard to prevail on. I don't think that is a slam-dunk at all. The fish is mute, expressionless. The fish doesn't think because the fish knows everything. | |||
