I know the stupid 1927 law makes no sense, but it’s still the law, and what the DOJ says is just an opinion and not law. Until someone court rules the law unconstitutional, who, except FFLs, is going to start shipping handguns via USPS?

Nobody will, it's part of a case being argued and the DOJ is basically issuing it's stance on the law. If successful then anyone can ship a gun via USPS.

The law is the law, but one thing this new ruling should make clear is that the odds the DOJ would actually prosecute a violation are pretty slim.

Maybe so, but who’s going to risk shipping an expensive firearm via USPS until they agree you can purchase shipping insurance for loss or damage that they’ll stand behind?

Yup. The DOJ's opinion is not the law. Until the court rules that the 1927 law is unconstitutional, no sane non-FFL is dumb enough to start shipping handguns via USPS.

Yes, we can’t rush out and start shipping handguns via USPS yet. However, it is a breath of fresh air to have our Federal Department of Justice making this argument. Hopefully the judge agrees and it goes somewhere, but at least the DOJ is on our side on this one.

I can imagine that happening that happening under the last administration. Nor can I imagine it happening had PDJT not prevailed in 2024.

Lawful or unlawful, do not send a gun or anything else of value through the USPS. This comes from a man who worked for the Post Office for a few years.

No matter how legal it becomes, I would not ever expect USPS to pay an insurance claim on anything. They may, but I always assume they won't and only buy insurance if it's part of the deal with my buyer.

^^^^ With the ATF now on their ass because of a lost (translation, stolen) firearm, you can bet that they will get their act together. It’s no longer a lost gun part that they can bully people into submission like they did to you.
