Non Compete Question: Updated question on Page2 Login/Join

This cannot be as difficult as it seems.

I have a friend who is considering leaving her job and cannot work within 10 miles of her current location.

All I want to do is enter her address and draw a 10 mile radius on the map.

Easy right? Nope.

Help???

You can probably do it in Google Earth but not Google maps.

Try this. It seems to work okay. I just messed with it. A little of a PITA, but it works. She will have to blow up the map and figure out the areas.

Seriously, what business is she in? Most employers won’t even check if she’s that close, or follow up with legal action. It’s not affordable and a scare tactic.
That said if she signed an agreement... integrity, etc.

Hair dresser, private ownership. These folks have deep pockets and will cause her hell. She's been with them for years, signed a non-compete at the beginning of her employment, and is stuck.

She's very good at what she does, but is not permitted to raise her prices to complete with other girls in the salon "someone has to be the lowest price"...etc.

I've used the term 'indentured servant' more than once. 10 miles is a long way when you are asking clients to follow you.

I appreciate all of your help, I'm too tired/stupid to figure this out tonight. Really the bigger goal is to figure out how to get her out of this non-compete.

She spoke to a lawyer here in MN and was told they are pretty enforceable - hmmmm....going to bed. Need to think on this.

You could print the map, and hand draw the ring using a compass. Just know the scale of the map and you should be good. You could even plot some ten mile points on the map before printing as guide marks. Not ideal but it should work.

Just right click on any point on the map and choose the last choice - measure distance.

You could also use this feature to draw a 10 mile by 10 mile square around the point. That'll give you a general idea.

What's the address? i can take a stab at it. .

Okay, understandable. I have a no compete, but it just says I won’t make lotion or lip balm.
Getting out of it is damn near impossible. How long is it in effect? 12 or 18 months?
Sad to say, but if they have deep pockets and are standing their ground, she may just have to move on to somewhere different and start a new client base.

That said, i would drive 20 miles one way, to get a decent high and tight. I moved from an area with military barbers everywhere to a town where I had to show pics of a high and tight. She may not be as bad off as she thinks. If she’s that good, people will follow.

Any severance? Generally employer has to provide something so as to be equitable in the deal since they are keeping someone from working in their field.
I can see her not being able to solicit clients but they really can’t prevent clients from finding her.

I always thought that women were strongly faithful to their hairdresser and would follow them to Hell if necessary. Has this changed? Here in Texas a 10-mile drive for something isn't even given a negative thought.

My mom drive from Franklin NC to Waynesville NC, 38 miles apart.

My big kid does hair, his clients would go ten miles .

Just curious, how long does the non compete last?
I'm kind of surprised a lawyer said it would even hold up. Have always heard the more restrictive the less enforceable they would be.

I thought a court ruled a few years ago that non compete clauses were unenforceable. If she's serious about leaving her current employer it might be worth to consult an attorney. With that said if the non compete is enforceable 10 miles isn't a great distance to commute unless the majority of your clients walk or depend on public transportation.

She did speak to a contract attorney a couple of years ago, and was told Minnesota has a history of courts friendly towards non-competes.

In her case, there isn't a specified penalty... the terms of the contract are that she cannot work within a 10 mi radius for 2 years, whether she quits or is fired.

The contract atty she consulted said that they can sue her for their loss of the profits she brings to the salon In that 2 years...about 100,000

These are not the type of people who would ever consider releasing her from this.

Is her not being allowed to raise her prices not a violation of their contract? I would think something like that would be in the original contract. Who is the contract with? The owner of the salon, or the other girls? Is the salon owner telling her she can't raise her prices?

Yes, the owner of the salon. And what you mentioned about pricing is an angle I have been trying to explore...the other girls have higher rates than her, and work the better shifts. She's the newest person in the shop (even after a decade) and continues to draw the short straw when it comes to this stuff.

"Somehow" there has to be a powerplay where their not letting her compete with the market in pricing affects how well they can or cannot enforce this contract.

I believe this to be the case. It's even true, to a degree, for some men--and I'm not talking about nancy-boy millennials wont to sport man buns, but regular guys who have somebody that cuts their hair just the way they like it.

Personally, when I'm obliged to change barbers I always make sure to get my Haircut Records for the new barber.

I'm not sure where "belly of the beast" is so this may not be possible in your location but I think her best option would be to find a place 10.5 miles down the best commuter road and set up shop. If she is really that good at it her clients will follow her a lot further then that.

My wife has followed her hairdresser around for over 20 years. I just asked her how far she would follow her and she said anywhere in the Jacksonville area. Keeping in mind that you can drive 40 miles and still be in Jacksonville, 10 miles is probably a bigger issue to her then to her clients.
