“VBVAGUY SAID: I will be given 6 weeks severance pay or being terminated and collect unemployment. I have not decided yet.“

It seems to me you take the severance, and then when that ends file for unemployment. You can appeal to the state that you were “forced” to quit and you may still get approved for unemployment insurance after your severances paid out.

I was terminated when I refused a change of location; we (wife and I) had been moved around so much in that job that we would wake up in the morning not knowing what zip code we were in. I told them "the moving van stops here."

The severance pay that was offered was contingent on signing an agreement not to seek unemployment compensation.

I told them to ram it, slam it, jam it, and cram it, so they withdrew the severance offer, terminated me immediately, and then tried to squiggle out of paying me for accrued vacation. I immediately touched base with an employment type lawyer who was in our BMW motorcycle club. He fired off a letter to them; the ex-employer immediately responded with a check for the full amount of accrued vacation, two weeks of pay for each year that I had been with the company, and five hundred to the lawyer to cover the cost of the lawyer-letter.

It seems that I had retained a copy of the proposed agreement to refrain from seeking unemployment compensation; for some reason the ex-employer was not anxious for that to fall into the hands of the state agency that handled unemployment comp.

Each state laws and rules for collecting unemployment insurance are different.

So we would need to know which state

Generally, take the payout and file for unemployment. The employer can object but that costs time and money to do.

Key in timing is the severance and how that is paid. Lump sum vs periodic payments

Sent me and email if you want to discuss further

And 1000%. When one door closes two open. July 2020 the firm I worked for “performance related” departures. Was able to take time off and have found a marvelous job this past Feb. And performance my ass. Applied to 5 jobs. 4 made offers and the 5th I was overqualified. (Mega close to home).

At least in my state, if you resign, you cannot collect unemployment. I'd ride it out and take the unemployment for the longer term option, since nobody knows what the future holds. But that sounds like a different situation than the OP has now, so who knows what the OP should do (besides seek financial counsel with someone experienced locally).

You are being forced to quit, which is the same as being fired.

Take the severance (provided you have no reason to believe that your termination is wrongful), and then file unemployment anyway.

You've been paying into unemployment. It's yours to use.

Will they give you anything in writing as to resigning with 6 week pay or being terminated with nothing? I would contact an attorney in your area and see what the law says about this

What kind of job are you qualified for and how long will it take to find a job in your area with about the same pay? If you resign and get 6 weeks pay but it takes a couple of months to get a job then unemployment may be a better deal.

there are jobs out there and I believe in an honest day pay for an honest days work but don’t want to have to take a job I don’t like with less pay just to be able to pay bills and then have to quit it when a better job come available

I quit a job at Verizon Yellow Pages long ago. In that job they advanced us on commissions. My boss asked me to sign a form stating I had booked a bunch of bogus sales and understanding they would claw back commissions from future paychecks. I laughed and asked if she was joking. She then crumpled the form up and tossed it in the garbage can. It's pretty unreal what major companies think they can get away with. I'm sure some people signed whatever they were given.

All the lay-offs I've come across, if they offered a severance package, didn't negate getting unemployment benefits.

That really is a dick move on their part. The severance pay isn't going to break them.

I don't like the idea of being forced to resign. It's as if I did something wrong. And at my job interviews, if I answer the question, why'd you leave your last job, "They made me resign" sounds worse than "they had to do lay offs."

Hate to hear this but on the positive side, there is no better job market than now. That severance seems low, typical is 1 week per year of service. I would check the handbook.

Whatever they offer 1) try to goose it up in your favor. You got nothing to lose 2) get it all in writing

Sucks man. I got laid off in the dot com bust of 2001. In about June but they gave us 2 months notice. And benefits for 2 months more after that. I used their computer to search for jobs while doing the least I had to for those 2 months. I wasn’t married then, no kids and had no mortgage back then but it still caught my with my pants down financially. I’m probly a bit over conservative on my investments these days because of it and keep well more than a full years expenses in my “the world ends” savings account. But I have a mortgage and kids. Wife doesn’t work.
