Very true. Even though the server and private email may not have been illegal (and that seems like a loophole, if congress is looking to close loopholes...) the fact that it was used for official communication should mean it was subject to the federal records act. Meaning she should not have been the one to determine what was official and needed to be preserved, and what was personal and could be deleted.

Now storing and transmitting classified information across it is a whole 'nother matter.
