Scuttlebutt has been that states like CA, NY, IL would use the medical MJ registry as a source for going after firearms, carry permits since you can't use MJ and buy a gun.

SAF SUES U.S. AG, HEADS OF ATF, FBI OVER MEDICAL MARIJUANA 2A BAN



BELLEVUE, WA – The Second Amendment Foundation and a District Attorney in Pennsylvania have filed a federal lawsuit against Attorney General Merrick Garland, the heads of the FBI and ATF, and the U.S. Government, challenging the federal prohibition on gun ownership by medical marijuana users.



The lawsuit was filed in U.S. District Court for the Western District of Pennsylvania. In addition to Garland, the lawsuit names FBI Director Christopher Wray and ATF Director Steven Dettelbach as defendants. SAF is joined by Warren County, Pa., District Attorney Robert Greene, who has served in that office since 2013 and currently possesses a medical marijuana ID card under Pennsylvania law. They are represented by attorneys Adam Kraut, who serves as SAF’s executive director, and Joshua Prince of Bechtelsville, Pa.



The lawsuit challenges restrictions contained in 18 U.S.C. §§ 922(g)(3), (d)(3), which prohibit firearms purchases and possession by persons who use marijuana or other controlled substances.



“Medicinal marijuana has been adopted by 38 states despite federal inaction on the issue,” said Kraut, who is also a practicing attorney in Pennsylvania. “With the increasing acceptance of medical cannabis, millions of Americans are forced to choose between the exercise of their Second Amendment rights or treating their symptoms with a substance that disenfranchises them from their constitutionally guaranteed right to keep and bear arms. Such a choice is incompatible with the constitution and finds no basis in this country’s history and tradition. We look forward to vindicating the rights of medical marijuana users.”



“The use of medical marijuana should not translate to an automatic surrender of one’s Second Amendment rights,” added SAF founder and Executive Vice President Alan M. Gottlieb. “The current restrictions unquestionably and arbitrarily infringe on the right to keep and bear arms, and the restriction lacks any direct or analogous historical support, as required by the Supreme Court’s 2022 Bruen ruling.”

Since September 2011, BATFE's position is that possession of a medical marijuana ID card, of and by itself, makes you a prohibited person, even if you have never used marijuana.

I've long wanted to see that aspect of BATFE's policy taken on in court.

Marijuana is illegal to possess on the Federal level but the Feds don't prosecute users, just users who possess a firearm.

It should be thrown out just because of selective enforcement alone.

1000% Agree! Selective enforcement is dogshit and it needs to be rendered impotent whenever possible.

I would suggest that Alcohol is a bigger problem in terms of general impairment.

I've been saying for a long time now that it is only a way to legally go after gun owners who are otherwise not criminals. It's why they won't change the scheduling on it, it's why they won't remove that verbiage from the 4473, and it's why they're going after medical card holders.

I'll speak up on this for those who have no experience with it, but if you walk into a shop, be it medical or not, you have choices. It boils down to three ways to ingest the stuff. Every clown knows you can smoke it, some know or care that you can eat or drink it when it's been cooked into something with either fats or alcohol, but far fewer still know about it as a topical for severe joint pain and that it will actually make it go away. Icy Hot and Tiger Balm and all that stuff only confuses the nerves - the signal is masked, so the brain doesn't know exactly what's goin on there and the stronger sensation of tingling or cold or what-have-you takes over. A topical rub or cream with a high THC concentration will do something those of you who've used the "legal" OTC stuff have never experienced: you apply it, and the pain goes away. Full stop. CBD may work for you, or it may not. It didn't do anything for me. Took a few applications to start working, but the stuff with high concentrations of THC worked wonders. And no, you don't catch any kind of buzz of it. I have experienced a legit medical use for something the government says has zero medicinal value. I won't walk into a shop since I got sober, so I really hate that this stuff is illegal, especially with this front dumping all this rain since Sunday.

Selective enforcement has been a thing, as long as there have been prosecutors, I think.
