To sum up some of the questions and comments here, I am a gun crime detective with a local agency. My job is anything dealing with guns, from larceny to violent crimes. I still get assigned fraud cases, and burglaries from time to time, but the vast majority of what I do is gun related, to include thefts and larceny.

The first step is to make a police report if it truly is a theft. You have the serial number so that is way yonder ahead of a vast majority of stolen gun cases that I work. Once the police take your information, including the suspect information, if it truly is a theft, they'll enter the serial number into NCIC as stolen. So, when the serial number is ran by LE it will come back as stolen nationwide. However, you have to make that original report with the agency with jurisdiction before it can be entered. It is not uncommon for stuff to wind up in Chicago. Matter of fact, week before last, we had a pistol turn up in Chicago that was stolen from my jurisdiction.

Depending on the size of the agency, and the agencies SOP's, your case should be referred to someone in general investigations or gun crimes. If the detective is on the ball, there are many data bases that he can search that will make short work of checking out your suspect, his financial and pawn history, etc. If the trail goes cold on what leads that you have, the dope unit is your next best bet. Dope and stolen guns go hand in hand. Dope recovers a lot of stolen guns on dope warrants. Depending upon the state, when you get caught with a stolen handgun, you get charged with some form of receiving stolen property. Because it is a gun, it is a felony regardless of the pistol's value.

Best of luck to you. Get the gun reported and entered NCIC if you have not already if this is truly a theft.

Not in most jurisdictions. Why?
When does the clock start? Many collectors may not even know a gun is missing for months/years.

If I dont inventory all my guns daily, am I now commiting a crime?

If you loaned the gun and did not get it back as expected, notify the person that they have xx days to return it or you will report it to the authorities.

Strange. I don't understand the logic behind wanting to "post" info on a stolen guy, but not actually do anything about getting it back via police and apparently KNOWING who has it. That's just weird.

Personally, the fact that the person has apparent issues would just make me that much more concerned with where that gun, which ties back to me, may end up. I'm not taking that risk to give anybody latitude, let alone someone who stole from me. That's just ill-advised in my mind.

This story makes no sense.

The handgun was loaned to another.
Apparently resistance to the return is going on.

Now the owner wants to clime it's a stolen firearm when they know who and where it's located.

No reports filed with law enforcement? I see a civil liability when nothing has been done to actually document the theft.

I's wonder if the person the firearm is now in possession has the ability to legally own or possess one?

Even if the firearm is located, three's no way it's simply going to be turned over to someone claiming to be the owner without some documentation.

I's say the longer this goes on, the deeper the hole being dug.

That is the missing piece. I suspect (if any of this is fact) loan was made to someone not able to buy a gun. If so, that's the dumbest thing I've ever heard of, or at least in TOP 100.

It would explain why the OP would be reluctant to simply call the police and report. He may have gotten himself into such a pickle that he simply can't extricate himself without subjecting his own smart self to issues. I'm not sure "listing" it stolen is going to help him, but in any event he's just waiving goodbye to that Sig.

Yep, oh and if I loan something to someone. Request it back and do not receive promptly. Then it is stolen.
