Certainly not 'untouchable'. As long as he's drawing retired pay, he is still subject to the UCMJ. Bringing him back to active duty and courts martialing him would probably be a stretch and a become a media-fest, giving him more public exposure. Going administrative ILO legal is easier IMO and there is no appeal.

I hope he's sweating bullets.

Heard judge Andrew Napolitano saying something yesterday about him being unable to be recalled to active duty because he's a sitting senator, hope there's a workaround if that's the case.

The board will determine the last rank/grade in which Kelly served satisfactorily. He last served on active duty as a Captain, 06, and his service in that grade was presumably satisfactory (or he would not have been allowed to retire at that rank).

The trick to this case may be, was Kelly "serving" as a Captain when he issued the statements? Maybe, if he was holding himself forth as a "Captain, USN, retired." This is the paradox of the regulation authorizing these determinations - if you cannot peg the act to a time while serving in a particular grade, you can't determine the last satisfactorily held grade (e.g., usually the one before the offense). The action contemplated is not a "punishment," per se; it is rather an adminstrative "correction of the record" made after something is determined after the fact to have been unsatisfactory service.

The way I read the statements, Kelly and his cohorts were transparently baiting someone - some impressionable young servicemember - to throw away his career in a huff over something he or she thought could be "illegal" because of some policy they didn't agree with. That would then reap a political benefit for Kelly's party, because it would embarass the President.

The idea of an illegal order means being told (ordered) to do something that is forbidden in military law, e.g., being told to shoot a prisoner. It was never meant to cover disagreements in policy, e.g., being against an operation on political grounds, or testing the theory that the U.S. cannot conduct military operations without a declaration of war, which is a theory that is hard to prove based on precedent established during countless operations since WWII.

Remembering a conversation I had with a former boss who was a retired 06, he told me about another Navy captain he knew when he was active who was corrupt and did things so underhanded it would curl your hair (that is a quote). I worked under him for several years and respected him for his competence, predictable and above board company political skills, and personal integrity. All this to say that perhaps Captain Kelly was one of those kinds of officers who got promoted by slithering and sliming his way up the ladder, like we have all seen others do in all kinds and lines of work. So if he was a great officer and accomplished aviator and astronaut, does this necessarily mean he was a solid and good human being ? Based on his previous and current behavior on captial hill, my guess he's been a bad human being from the git go. I can't respect that since people like that don't all of a sudden become corrupted after a solid life of exemplary service and integrity. Tigers like people don't generally change their stripes like that. Not to say it's impossible, every man has his limits, but it seems this man has shown himself to discard decency, integrity, and the honor of his military service, and just decided it was OK to be a dog. My guess is he's always been like this since the day he was born, like every other bad person at all levels of society. So to me his accomplshments are for naught if that's his life's story. Perhaps I oversimplify things in order to make sense of things I can never understand from the viewpoint of a plain and simple life.

So yea, for all the great things Trump is getting done and for saving this country's royal ass, Senator Kelly can just pass go and go straight to hell.

The best I can hope for is his political capital has been damaged beyond repair…so no re-election is absolutely in the deck now. Fuck’em both!

I can't agree more.He's a sly opportunist and as a nasal radiator saw the opportunity to leech onto a National figure, who, and bless her heart, was a national figure because of the attack not for anything particularly exceptional about her. I say that last part with respect, most of us aren't particularly exceptional either.
