MADISON, Wis. (AP) — A federal judge has ordered Wisconsin to pay for the gender reassignment surgery for two transgender Medicaid recipients.

Cody Flack, 30, and Sara Ann Makenzie, 41, filed a lawsuit in April, saying a state rule denying coverage for surgeries to treat gender dysphoria violates the Affordable Care Act and their right to equal protection, the Milwaukee Journal Sentinel reported. The state rule that excludes coverage for undefined "transsexual surgery" was adopted in 1996.

U.S. District Judge William Conley granted a preliminary injunction Wednesday barring enforcement of the rule. He suggested the injunction could be expanded to include any transgender Medicaid patient whose doctor recommends the surgery.

"The likelihood of ongoing, irreparable harm facing these two individual plaintiffs outweighs any marginal impacts on the defendants' stated concerns regarding public health or limiting costs," Conley said in the 39-page order.

Flack could get his surgery in two or three weeks, said Attorney Rock Pledl. He said Makenzie may have to wait a few months because of her status on the paperwork process with an HMO.

Flack, who has cerebral palsy, uses a motorized wheelchair and relies on Supplemental Security Income for the disabled as his sole support. He first identified as a boy at age 5, according the lawsuit. Makenzie is also is disabled and relies on Supplemental Security Income. She has been living as a woman since 2012.

"This is tremendous," Pledl said of the ruling.

The state's Medicaid has a budget of approximately $9.7 billion to cover about 1.2 million eligible residents. An estimated 5,000 of enrollees are transgender.

First I would contend that chopping off someone's penis would cause irreparable harm. Second, marginal? Does judge even understand the pre-op, surgical, and LIFETIME post-op costs he just put them on the hook for?

As I read it, this decision is characterized as a preliminary injunction barring enforcement of the 1996 state rule excluding coverage.

Then one of the plaintiffs attorney's states that one of the surgeries could be done in two or three weeks.

That hardly sounds like enough time for the state to appeal this decision and the unfunded and utterly unsustainable financial burdens which it would be subjected to if this is allowed to stand.

Likely doesn't know, and more aptly, doesn't care. Just bend to your elitist betters, head back to work, and pay your taxes. This judge and others like him will determine where the fruits of your labors need to be spent.

A 2013 University of Louisville, KY study of 351 transgender individuals found that the rates of depression and anxiety symptoms within the study “far surpass the rates of those for the general population.” About half had depressive symptoms and more than 40 percent had symptoms of anxiety.

I love reading this whilst I battle with the WI DOR over my taxes.

There is almost complete consensus of relevant experts that gender "reassignment surgery" that is attempted sex change surgery, solves no problems and ends up causing irreparable harm to the recipient. Although it feels good to the activist supporting surgery for others.

SACRAMENTO — A 57-year-old convicted killer serving a life sentence in California is the first inmate in the United States to receive state-financed sex-reassignment surgery, the prisoner’s lawyers said.

California prison officials agreed in August 2015 to pay for the surgery for the inmate, Shiloh Heavenly Quine, who was convicted of first-degree murder, kidnapping and robbery for ransom and has no possibility of parole.

Ms. Quine’s case led the state to become the first to set standards that will allow other transgender inmates to apply to receive state-financed sex-reassignment surgery.

It also prompted a federal magistrate to require California to provide transgender female inmates housed in men’s facilities with more female-oriented items like nightgowns, scarves and necklaces.

Probably because SSDI income doesn't meet threshold to preclude them from enrolling and they've likely spent down any assist they might have had in order to qualify. Complete wards of the state.

In the 1970s when these issues first surfaced, there was a requirement that prior to any gender surgery taking place that an extensive psycholgical evaluation be conducted to rule out the very issues mentioned above. At that time there were only two centers in the United States that performed the surgeries and there were many steps to be taken before actual surgery.
