If he's a prisoner of war, if his actions were an act of war, he hasn't committed a crime... Or if he has it was a war crime and he should have been tried by a court martial under the laws of his home country not in a civilian court under US laws. Waging war is itself not a crime.

If he's an enemy combatant by trying him in a civilian court and holding him in a civilian prison WE are committing a war crime. Enemy prisoners of war are only held in conditions that prevent their escape and prevent them from further assisting their side's war effort.

I think we're better off saying he's a civilian who committed a crime, rather than an enemy soldier.
