Actually yes. I just haven’t had time to get the cites together on the case law that says this statute doesn’t apply to trailer park type threats. Not to mention, the 2014 SCOTUS ruling that neutered 845 type laws and requires the AUSA to prove actual intent that the party making the threats furthered a means to carry the threat out.

In short, the statute doesn’t apply. There has been the idea that the statute never applied to online threats, that it was interpreted as a RICO statute that dealt with extortion and kidnapping. The courts recognized through case law in the state and federal that just because Someone makes threats, such as to an ex-wife, on social media, that is free speech. No matter how much it makes the rest of us sick.

So, that statute does not apply.

Sorry, but I don't have that hope. She was elected from a solid Blue district. Even Nancy Pelosi said that a glass of water would be elected there if it had a "D" by its name. The only way AOC will be deposed would be if another Democrat sidelined her in the Primary, and I suspect such a person (?) would be even worse than she (is that even possible?).
