If the home-owner had not been armed, then he and his partner might have been killed by this jerk. The homeowner handled it the way I would have. The intruder acted like he was drunk or high and wasn't a physical threat once he got off the patio. He got arrested and that is the best outcome. Immediate threat removed, the "homeowner" held his firearm loosely at his side, and clearly didn't feel much of a threat. The exchange was verbal at that point. The person attempting entry had loose clothing which could have hidden a weapon. I don't know that I'd be too quick to assume the man was unarmed or to lower guard simply because he may appear to not be a threat. The response time of the "homeowner," with firearm in hand, is good. | |||

The intruder spends considerable time pulling up his pants, or possibly controlling a pistol. Does not look excessively drunk or high to me, he could change to a robber/killer in a second. -c1steve | |||

Someone has a signature line to the effect that 'you can get further with a kind word and a gun, than just with a kind word.' This would seem to prove that point. Homeowner did very well, and I have to say the intruder reacted well - retreated, put his hands up, became a non-threat. | |||

I have only two things to add: 1. This is why I keep my doors locked even when at home. 2. I would have kept my gun at "high-ready" (I hope that's the right term) until he was out-of-sight gone. Good response by the homeowner; the guy looked like he wasn’t completely in charge of his faculties, whatever the reason. Latching the gate after getting on the porch didn’t scream burglar to me.
