I need a good eviction lawyer to get a tenant out that's behind on his rent and I just had to baker act him right after I gave him his 3 day notice for being late on his rent and he talked about committing suicide. He's a major binge drinker and flooded his unit and the adjoining unit in December, about 10 days after he moved in. Police/ambulance took him away and not sure where to go from here.

Good luck on this Jimmy.

Often turns out to be complicated and messy, since several "agencies" are involved.

You can probably save a lot of money on the eviction by going to the clerk of the court and initiating it yourself. They should have a template Writ of Possession, which is pretty simple. Just be sure to include the words "and all other persons" after the name of your tenant. Once you submit the Writ of Possession and pay the fees, within a couple days the sheriff's office should post the 24 hours notice on the property; 24 hours that, the sheriff's office should return and place you in possession of the property. Access Florida Statutes Chapter 83 online and you can find what must be done with property the tenant couldn't or didn't remove. That chapter will refer you to Chapter 715 on the steps to dispose of the property. I am not an attorney.

In Texas, it is easy for a landlord to evict a tenant. L90814 seems to indicate that it is similar in Florida, too.

Maybe you could hire a lawyer to do this one, and offer to pay him extra to teach you how to do it.

I handle some Texas evictions for some big corporate landlords, but I only handle their appeal cases - the apartment managers handle their own initial cases. Even the appeals are easy, but they go to a different kind of court, and corporations have to be represented by licensed lawyers in that court.

Jimmy I can handle it. I’m on vacation in Arizona until Tuesday but can get on it now. Send me the lease, and 3 day letter to my email in my profile and we can touch base offline.

I know it's not terribly difficult, but have heard of a lot of them getting thrown out of court on a technicality, wrong date, etc. I also don't have the patience for it or want to deal with it myself. I'm self employed managing yachts and as a Captain and sometimes a great paying trip pops up and have to leave in a few days, would rather work doing what I do and pay someone else to handle this.

If you have not done this and the tenant has a lawyer you are risking a lot.

Get a lawyer to file the paperwork.

Hope you get lucky and the tenant does not show up to defend or shows up defending himself.

There are tenant legal aid groups that will go after you for millions. Mostly for practice.

I evicted lots of tenants myself, but if it looked like it would get complicated I hired a lawyer eviction specialist.

Not cheap upfront but cheaper in the long run.

It sounds like Jimmy has a lawyer, a SigForum member in fact. After the eviction is finished go watch Pacific Heights if you have not already seen it.

You mean have the guy beaten up? Razz

That movie does pretty accurately depict how hard it can be to get rid of a problem tenant.
