Three-Judge Court of Appeals Panel Strikes Down DC Magazine Ban

A three-judge panel of the D.C. Court of Appeals struck down on Thursday Washington, DC’s, ban on magazines holding more than ten rounds.

The Second Amendment Foundation announced the panel’s finding that the “ban on magazines over ten rounds is unconstitutional.”

The panel ruled two to one against the ban. The New York Times noted that Judge Joshua Deahl, a Trump appointee, observed that magazines holding more than ten rounds “are arms in common and ubiquitous use.”

Deahl also pointed out that the D.C. ban could not survive the scrutiny of the Supreme Court of the United States’ Bruen (2022) ruling, as there is no “history or tradition” of banning said magazines.


Chief Judge Anna Blackburne-Rigsby, a George W. Bush appointee, dissented.

In the dissent, Blackburne-Rigsby described 30-round magazines as “particularly lethal” and claimed they are not in common use for self-defense.

I simply love that the left is having to adjust their language and arguments to fit our language and arguments instead of the other way around. It shows they are on the defensive.

Duncan v Bonta out of CA is a similar case from California. Its ping-ponged quite a bit, after eventually having the bans upheld in the 9th (en banc), then vacated by the Supreme Court, and once again upheld by the 9th. It is awaiting action by the Supreme Court again.

I'm no scholar but I think contrary ruling in a different Circuit is good for getting the Supreme Court to take action. Is the DC Court of Appeals equal to a Circuit court of appeals or is it a lower court?

My guess is, a new law will be drafted, with slightly different wording, and put into place before the end of this month.

The new law won't prohibit the normal size magazines but will only apply to those bought in the District by residents who have three forms of government issued, photo ID, to include the one issued by the Chief of Police showing the buyer has passed an extensive background check (at a cost of $100 per three magazines to be purchased, and valid for 364 days).






Life moves pretty fast. If you don't stop and look around once in a while, you could miss it.
