Our HOA has had three different presidents since we moved here. The first president was mediocre, but the second (Dave) was fantastic! Seriously, the property values increased much more rapidly than other real estate in our area while Dave was in charge. No non-running vehicles sitting on the street looking like they haven't been touched in years; no debris leaning up against the sides of homes; no vehicles parked on the front lawns, no unsightly bldg. issues that go on un-repaired indefinitely. Every house looked as though it was owned by someone who takes pride in the appearance of their home.

Now, we're with a third president, and those issues are beginning to re-appear.

My understanding after talking with Dave is that some people don't like it when the association compels them to take pride in the appearance of their home - those people want to live in their filth and state of disrepair, and they don't appreciate it when someone asks them to be considerate of the other people in the neighborhood.

The HOA better be sure of their position before they call the sheriff. Recently in Utah there was a class action lawsuit brought by some HOA members who were wronged by their HOA. I do not know the specifics, but the HOA lost, and as I understand it, everyone in the HOA who did not participate in the lawsuit got hit with a huge assessment.

If you knew someone in the sheriff's office who could tell you how they would handle this ahead of time, someone wanted to fish could call their bluff.

That's a great example there, synthplayer.

Why is it so hard to want to live with like minded people who take pride in the appearance of their homes? Who doesn't want to live in a pleasant neighborhood?

I certainly wouldn't mind living on a few acres by myself but that's not practical for us now.

I'm going to take pictures of the shit across the street, post them and ask who here wants to live around shit like that.

HOAs swing back and forth. A couple of years ago they failed to get a quorum at our annual meeting. The board members terms expired and it looked like the HOA was dead. Then the HOA was sued by a homeowner that did pay his dues. He claimed his wife suffered emotional distress by being asked to pay dues. Some genius hired a parliamentarian to run a HOA meeting.
The guy started by telling us the board members stayed on until the next vote. Second, if you don't get a qourom at one meeting, you call a second. This time the qourom is half the first. "In fact you can get down to two members and it's legal."
That was fixed but last year we got a bully on the board. The rules said no tree over 25' so he started sending demands to cut trees down. This ended as he was caught trespassing on private property and demanding people cut trees on someone else's property. Faced with several personal lawsuits, he resigned. Since then things have been reasonable. Mostly due to the board. Then there was the case of an inactive HOA and a new house. The guy was building a huge three story that blocked an amazing view from other houses. The HOA was resurrected and the guy taken to court. The judge ruled the HOA wasn't inactive and after a bit ruled against the builder. Meanwhile the guy continued to build and went back to court claiming the house was done and how much money he'd lose. The judge directed that he take a story off, move or tear down the house.
Point is, an HOA is what you make it. People have to volunteer. They have to know the rules and the parliamentary rules. Last, the have to beat down the idiots that want it their way.

Live in a pleasant neighborhood? According to who? Screw these nosy assholes. That's right.

If I want to leave a ladder up aside the house indefinitely or park a rig with the hood up until I fix it, I will.

I would never live in a hoa. People need to deal with their own stuff, not others. If you do not like it. Move.

We live in HOA, $220 per year. We have a community pool, a park, paved walking paths. We also get our streets plowed. The rules aren't that bad. We have to get approval for fences, sheds, exterior paint. I don't mind the rules. I lived in non-HOA and had to deal with neighbors who didn't care about their home and property. The home values were going down because of the poor upkeep.

That was obviously the fault of the homeowner. You should know HOA rules before building. If you don't bother to check then you pay the consequences.

Not for me. If you gave me a house in a HOA neighborhood it would immediately go on the market. No way I would ever subject myself to the nonsense of some numbnuts with a Napoleon complex telling me what I can or can't do on MY property. No way, no how.

Yep.

No way, ever, do I let some motherfucker(s) in my neighborhood dictate what color I can paint my fence, or whether I can build a shed, or 1000 other things. Absolute crazy talk. It is completely antithetical to the idea of owning my own place. Who thinks up this shit?

(rhetorical)

This is why I live in HOA. I don't want neighbors not giving a shit and bringing down property values.

One can get the CCR's anytime he wants. You don't have to wait until the closing.

Amazing how many people love socialism around here. Razz

Freely entered voluntary association.

It's called civil society.

Not really freely entered if you're forced into it when buying the house.

You've ever been forced to buy a house?
What is the point of your posting your one sentence question 3 months later? Are you trolling?

Don't like them, don't buy a home in one. I kind of wish we had one here to make these crackers across the street straighten out their shit.

I lived in a Detroit neighborhood for 30 years and had to deal with many shit stains that didn't care about their property. I wonder how many people complaining about an HOA have actually lived in a trashy neighborhood.

My ninety year old Mom lives in a gated, Senior community with of course a HOA.

She wastes all sorts of time to get permission to get a bush or tree TRIMMMED, or one removed and another planted.

Want a new screen Door? Waste a week and five phone calls.

When I visit and the rare time I drive out within a day someone is at the house asking WHY my vehicle is parked on the street. In a cul de sac, with 9 homes and little traffic.

YET....A woman suffering from dementia, lived in the house behind my Mom's...and broke EVERY rule they have, ten times over. And they did NOTHING about it. Her garbage blew into my Mom's back yard, her dog crapped in her yard, etc.

Last year I installed two new outside halogen lights. They were smaller than the originals, and very close to the same design. Midway into the install one of the busy body HOA guys drives by and stops. Gets out and somewhat rudely starts quizzing me on WHY I'm installing, did I get permission, etc.

I had said zero, short of "Hello" to him, when he approached. Grabbed him by the arm and walked him to the back yard....to view the mess from the neighbors yard, encroaching into my Mom's property. Told him to worry about THAT not what's going on with my Mom.

I could NOT handle a HOA , I'd be in jail in a year.

And I wonder how many people touting HOA's have ever lived in a mediocre, useless, or just plain crappy one.

HOA's don't make good neighbors. Good neighbors make good neighbors.

As far as property values, there seem to be just as many people likely not to buy a home in an HOA as who would. As I'm looking for a home, one of the things that is a big turnoff for me is an HOA.

Our communities' CCR's allowed for how we could form an HOA, if we wanted to. We did not. The only way we can enforce a CCR is direct owner to owner suit in court. For the most part, all of us have abided by the CCR's, and it works well. The one thing we can challenge are zoning regs, and that has been done successfully.

All one needs to do is buy a home in an area with good codes and code enforcement.

Vigilant cities are enough to forestall cars on blocks, unkempt lawns, and other nuisances. They will not normally tell you what color your house needs to be, or which lighting fixture to install. That's the job of your HOA.

We've lived in a community with an HOA for the last 15 years. Lawns are kept up, snow plowed, walking paths, clubhouse and pool. We have a good reserve of cash for maintenance and had new roofs and decks replaced.

The area always looks well-maintained and I enjoy being here. Neighbors are nice or keep to themselves. I feel like I won the intergalactic home lotto.

Things could change, but so far, so good.

You would think that people would give a shit and not let the place they live go to shit but people do.

They have no consideration for others who want to live in a decent, clean neighborhood.

If any of this shit looks normal and acceptable to you guys, I would hate to see how fucked up the inside of your houses are. Probably covered in dog shit with clogged toilets.

This dickwad has a big ass hole in his roof. It's been like that for at least a year since I have moved here. It was like that during the hurricane when it rained for twenty something straight hours. I wonder if any water got in there. Roll Eyes They have 2 cars that don't run, that sit there while they park the one running car they do have in the street. It's a narrow street, BTW.

Then you got this guy. Parking his car on the lawn like it's the fucking barrio. Then you got the big hunk of shit sticking out like an elephant in an elevator blocking the sidewalk. I guess a keyword in sidewalk might be walk. Walk as in people walk on it.
