I don't watch but an hour a week. But on a regular basis they show defendants in criminal cases in tiny claustrophobic booths answering questions , defending accusations and explaining everything , From soup to nuts. Set me straight on a couple of things. A. These people must have been read the Miranda stuff already , right ? 2. Why are they talking to any damn body without some kind of legal representation ? A) If you're talking about video of a custodial interrogation, then yes. Otherwise it's a waste of time, and not admissable in court. In fact, it may not be admissable anyway. 2) Because they think they're smarter than everyone else, or they're dumb, or they genuinely believe they can talk their way out of it. Also potentially because they very truly have nothing to hide and have done nothing wrong. (Although in that case you're unlikely to see it on CourtTV...) | |||

They talk because they are stupid. Just watched several episodes of "Making a Murderer" on Netflix. Pretty interesting old case. Anyway, in it there is a juvenile male that is CLEARLY low on the IQ scale. The show documents several interviews where the police are clearly taking advantage of it. Parents were not any/much brighter and didn't get it shut down. | |||

Ever single person I saw interviewed as a cop, thought they were smarter than the cops. Almost all of the gang bangers were trying to fish for what we cops knew. Smartest guy I arrested, asked for his attorney as soon as I put on the handcuffs and never answered anything besides the info for his fingerprinting..name, date of birth, race, etc. "Violence, naked force, has settled more issues in history than has any other factor.” Robert A. The smart ones ask for lawyers. Some percentage of the rest will talk. A good interviewer will talk to someone for quite a while before Miranda warnings are required. The stoic “You have the right to remain silent…” is the hallmark of someone that has no business doing an interview to begin with. You want an interviewer who has the gift of gab, who can spend 30 minutes getting to know the guy before the first question about the case. By then the guy may be chomping at the bit to be heard. “Hey buddy, you ever watch Law and Order? If you want to tell me what happened I’ve got to give you your *doink doink* Rights…” And the game is on. P. S. Miranda was an asshole. Knowing what one is talking about is widely admired but not strictly required here.
