Raised Hands Surround Us Three Nails To Protect Us |
Our boys took part in the YMCA’s annual triathlon as they usually do. Unfortunately our oldest crashed during the biking portion and caught himself with his face and his braces went through his face. The local orthodontist office was the main sponsor as they are with anything around here that involves kids. It’s also where he got his braces. One of the Orthodontists was there and removed the braces from his lip. Wife took him to urgent care and they cleaned him up and said it was too swollen for them to determine if it needed stitches at the time. The next day after the swelling went down only a couple portions of the wire went through so it was pretty thin and did not need stitching. We did not tell urgent care it happened at the Y. Last week before a lady called and left a message stating she works for the company the insurers the Y and they wanted to pay for our medical expenses. It was a busy weekend and I forgot all about it. She called back today and I missed the call as well and said she would call Monday. I presume that the Y self reported as we did not report it to anyone. Honestly, not too concerned about it just a few bucks for the Urgent Care deductible. Kids healed up and going to go finish the rest next week so he can actually earn the medal. Sounds old skool to me, the Y is trying to do the right thing. Thay ain't worried about no lawsuits from some hysterical parent who allowed their kid to do something which the kid might get hurt doing, the Y is paying the medical bill per (my SWAG) their conciseness about kids'. Life moves pretty fast. If you don't stop and look around once in a while, you could miss it. They may just be trying to do the right thing, they may be trying to head off a lawsuit. Neither one is wrong. Your mileage may vary, but I’d call them back, thank them for the offer, and decline. “This is an opportunity to teach my child that sometimes when you do stuff accidents happen. Life isn’t perfect, and most interesting things have some level of risk. That’s why you have insurance. Even if you are uninsured or underinsured, if you have a problem, it is your problem. Best thing to do is man up, deal with it the best you can, and drive on. However, I do appreciate the offer, and all the opportunities that the Y provides for kids. The Y reported the incident and their insurer opened a claim. What it sounds like they’re offering you at this point is compensation under the med-pay provision of the Y’s liability policy. Med-pay is a no fault coverage and unless they’re also asking you to sign some sort of release (or release language is subsequently attached to a check), that’s all it is. My son was hurt in a restaurant when he was younger. It really was an old design issue that caused the injury. The restaurant insurer called and wanted to make a settlement and asked me how much I was interested in. On a lark I said 10K. Received the check but since he was a juvenile had to wait till he was 18 years old to collect it. At 18 years old he bought a truck. Couldn't hurt to see what they have to say. I seriously doubt the kid is going to learn a life lesson about insurance from this, and "stuff happens" has already happened. To his face. Just let it be paid, thank them if opportunity ever arises and move on. They haven't asked for a release, it's ok for folks/organizations to do the right thing. Even if partially motivated by self-preservation. I certainly wouldn't be pursuing them for damages though. Realize that's not what urbanwarrior or others are suggesting. As you say, stuff happens.
