Went to an event at The Mahaffey Theater in St. Petersburg this evening. They had metal detectors at the doors, but I had secured my gun in the car. I didn't, however, leave my magazine and daily knife. I had to return to my car, no big deal. The facility is owned by the City of St. Petersburg (based on the property appraisers website). Based on my reading of Florida law, this is not an off-limits place as it is a municipal facility, not privately owned. No sports, not really a drinking establishment, no voting, no court.... Is it legal for the city to make this place a gun-free zone? -.---.----.. -.---.----.. -.---.----.. It seems to me that any law that is not enforced and can't be enforced weakens all other laws. | ||

Per Statute 790.06 (12), the type of facility you noted is not specifically mentioned: (12)(a) A license issued under this section does not authorize any person to openly carry a handgun or carry a concealed weapon or firearm into: 1. Any place of nuisance as defined in s. 823.05; 2. Any police, sheriff, or highway patrol station; 3. Any detention facility, prison, or jail; 4. Any courthouse; 5. Any courtroom, except that nothing in this section would preclude a judge from carrying a concealed weapon or determining who will carry a concealed weapon in his or her courtroom; 6. Any polling place; 7. Any meeting of the governing body of a county, public school district, municipality, or special district; 8. Any meeting of the Legislature or a committee thereof; 9. Any school, college, or professional athletic event not related to firearms; 10. Any elementary or secondary school facility or administration building; 11. Any career center; 12. Any portion of an establishment licensed to dispense alcoholic beverages for consumption on the premises, which portion of the establishment is primarily devoted to such purpose; 13. Any college or university facility unless the licensee is a registered student, employee, or faculty member of such college or university and the weapon is a stun gun or nonlethal electric weapon or device designed solely for defensive purposes and the weapon does not fire a dart or projectile; 14. The inside of the passenger terminal and sterile area of any airport, provided that no person shall be prohibited from carrying any legal firearm into the terminal, which firearm is encased for shipment for purposes of checking such firearm as baggage to be lawfully transported on any aircraft; or 15. Any place where the carrying of firearms is prohibited by federal law. (b) A person licensed under this section shall not be prohibited from carrying or storing a firearm in a vehicle for lawful purposes. (c) This section does not modify the terms or conditions of s. 790.251(7). (d) Any person who knowingly and willfully violates any provision of this subsection commits a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083. So, like many other things involving government, I guess its legal for them so long as they can get away with it, and a specific court case hasn't passed through the docket to set precedent. Florida is also a bit hokey when it comes to concealed carry at a hospital. Although the Mahaffey Theater is owned by the city I believe it is leased by Big 3 Entertainment who manages the venues. Section 354.458 specifically prohibits "any firearms or deadly weapon" in hospitals that provide mental health services. That might be a bit fuzzy. South Seminole hospital on SR 434 in Longwood is a clear case; there is a mental health (psychiatric) section. My wife used to work there. Not so clear, is a hospital that does not have a psychiatric unit, but might have a mental health professional on call for a psych consult. This looks like a gray area. הרחפת שלי מלאה בצלופחים | |||

My dilemma is found at a facility like Florida Hospital downtown. There 'is' a mental health complex on that campus, but 'not' in or physically connected to the main hospital. Sooooooooo, do I break the law by carrying in the main hospital when visiting a friend? The concealed carry statute is also stupid when it comes to... 12. Any portion of an establishment licensed to dispense alcoholic beverages for consumption on the premises, which portion of the establishment is primarily devoted to such purpose; Try getting to and from the bathroom in many restaurants without going through the bar area. And what if you pass a friend eating/drinking in the bar and stop to talk with them? Are you in violation of the law given you're standing in the bar? I tend to completely ignore this section of the statute. I bitched about this stuff to two Florida senators in the past who had no idea why I had an issue with these parts of the law. Gee, could it be that they never actually thought about the impacts of the law they were passing. My comment to them was, "if you want people like me to comply with the law, make it simple to interpret by everyone, or scrap it". ----------------------------- Guns are awesome because they shoot solid lead freedom. The owner, or management of any property has the right to exclude you with your weapon on their property. If they know you have it they can ask you to leave and if you do not leave you are trespassing. The same thing applies to hospitals as mentioned below. If they don't know you have it, no problem. I train security officers who work in hospitals and they run into this all the time-they know people are coming in armed but I they see it they will ask the person to leave.
