6-3, along expected lines, with interesting concurring opinions by Alito, Kavanaugh, and Barrett.

NY (and hopefully, MD, NJ, IL, CA, etc., in turn) can take their "may-issue" language and go to hell.

JUSTICE THOMAS delivered the opinion of the Court:
"In 43 States, the government issues licenses to carry based on objective criteria. But in six States, including New York, the government further conditions issuance of a license to carry on a citizen’s showing of some additional special need. Because the State of New York issues public-carry licenses only when an applicant demonstrates a special need for self-defense, we conclude that the State’s licensing regime violates the Constitution!"

Cool

quote:
The constitutional right to bear arms in public for self-defense is not “a second-class right, subject to an entirely different body of rules than the other Bill of Rights guarantees.” McDonald, 561 U. S., at 780 (plurality opinion). We know of no other constitutional right that an individual may exercise only after demonstrating to government officers some special need. That is not how the First Amendment works when it comes to unpopular speech or the free exercise of religion. It is not how the Sixth Amendment works when it comes to a defendant’s right to confront the witnesses against him. And it is not how the Second Amendment works when it comes to public carry for self-defense.

New York’s proper-cause requirement violates the Fourteenth Amendment in that it prevents law-abiding citizens with ordinary self-defense needs from exercising their right to keep and bear arms. We therefore reverse the judgment of the Court of Appeals and remand the case for further proceedings consistent with this opinion.

It is so ordered.

Awesome news for sure but being a pessimistic NY’er though, how does this help us for practical purposes? I’ve got to doubt I can stroll into my local licensing bureau, SCPD, and walk out with an unrestricted permit.

Thank God for Trump. What a legacy.

If this goes across the country which it should, then I hope reciprocity across all states for CCW holders become a fact.

"It did not really matter what we expected from life, but rather what life expected from us. We needed to stop asking about the meaning of life, and instead to think of ourselves as those who were being questioned by life – daily and hourly. Our answer must consist not in talk and meditation, but in right action and in right conduct. Life ultimately means taking the responsibility to find the right answer to its problems and to fulfill the tasks which it constantly sets for each individual." Read Alito's portion, pages 70-78 it is a fucking slap down and a great summary.

From Breyer's dissent:

quote:
In my view, when courts interpret the Second Amendment, it is constitutionally proper, indeed often necessary,
for them to consider the serious dangers and consequences
of gun violence that lead States to regulate firearms.

It is kind of appalling that the dissent blatantly inserts the "shall not be infringed" with "whatever we want".

^^^ I know they don't affect the outcome but it always has bothered me that the SCOTUS is so political and seemingly ignore the actual law when it is so obvious in many cases. Frown

I agree that this is a huge win and we should all celebrate it, but anti-gunners being what they are, they will fight this tooth and nail and attempt many ways to get around the decision. I fear that the fight is not over--many brush fires will have to be put out.

And there's always the possibility that NY will just fail to abide by the decision--what will SCOTUS do, then?--they do not have an enforcement division (and DOJ as currently controlled will not do anything).
