And his outraged family says the Democratic District Attorney in San Antonio is soft-peddling the charges after letting his attacker walk free following four prior arrests. Jimmy Friesenhahn, 44, who survived multiple overseas deployments including to Iraq during his 14 years in the Marines, is now paralyzed and can no longer speak. He was working at the El Patio Sports Bar, when he spotted a man apparently carrying a handgun in his pocket and tried to confiscate it, his brother-in-law Emmanuel Martinez told The Post. The customer, identified by cops as Wilmer Vladmir Ortega Ruiz, 29, refused to give up the pistol and they fought over it. Friesenhahn was shot three times, twice in the bulletproof vest and once through the neck. Friesenhahn, who is the father of a five-month-old baby girl, was left with a complete spinal injury, along with a ruptured esophagus and vocal cords. He has undergone six surgeries and is still clinging to life, but the prognosis has worsened, Martinez said. “Jimmy’s sacrifice saved people because there’s stories that the guy was going to go inside and do something in that place,” Martinez said in an emotional interview. Immigration and Customs Enforcement placed a detainer on Ortega Ruiz on May 4. But this wasn’t his first rodeo. Ortego Ruiz was first arrested in San Antonio and charged with a DWI in October 2020, according to court records. He was let go on a personal recognizance bond, but failed to show in court. The Bexar County District Attorney’s office then downgraded the DWI charge to obstructing a passageway. Ortega Ruiz pleaded guilty to that charge, but violated the terms of his probation and was arrested for a second time in August 2023. He was let go again after posting a $1,500 bond amount and failed to show up in court for a later hearing. The illegal migrant got collared a third time in September 2023 and bonded out for $1,500, again failing to show in court at a later hearing. He was then arrested for a fourth time in November 2024 and sentenced to time served nearly three weeks later. Ortega Ruiz was also allegedly the center of an assault investigation in which his girlfriend reported he physically attacked her, but he had fled the scene before cops arrived, law enforcement sources told The Post. Law enforcement sources said he sneaked into the country as a “got away.” Meanwhile, the Bexar County District Attorney’s office has only pursued aggravated assault charges against Ortego Ruiz and set his bond amount at $200,000 in his latest alleged offense. And the victim’s family is outraged, calling the repeated lax prosecution “a huge slap in the face.” That’s attempted murder, that’s not aggravated assault,” said Friesenhahn’s tearful sister, Evangelina Borjon. “It’s ridiculous the way the Bexar County Sheriff’s Office, the DA, the Bexar County judges, the whole justice system here is not caring and letting this guy off time after time,” said Martinez. Yes. But, while we all like to point fingers at the Judges, they mainly get their hands tied by the state legislature. This catch and release nonsense is largely on their hands and not the judges. States DO NOT want to pay for people to be incarcerated. The more money they spend on that, the less they have to spend on pork. So, you see all the compassionate bond reform, alternate sentencing, and pennies on the dollar sentences is all about money. | |||

In this instance, law enforcement has seemingly done their job by arresting the suspect and taking him into custody pending charges from the DA's office. The DA's office appears to be where things begin to go off the rails. Charging someone who has shot another person leaving that person paralyzed and unable to speak with aggravated assault is a travesty. Given the history in previous incidents of undercharging the suspect from this case, downgrading a DUI to obstructing a passageway for example, would seem to indicate that ideology is likely the foremost consideration at the DA's office with monetary concerns being secondary at best. Given this recent history of this DA's office, what would prevent them from downgrading the already absurd charge of aggravated battery in this case to a lesser charge? A jury can only rule guilty or not guilty on the charges filed on a defendant and if a guilty verdict is rendered, a judge is similarly constrained. Irrespective of what the office is called in any given jurisdiction, the prosecutor's office has tremendous latitude and discretion and is key to ensuring that justice is served when crimes are committed. DA's who fail to even present cases to a grand jury or who inexplicably undercharge defendants or wait until a case cools in the media and then quietly downgrade charges are largely to blame for the unprecedented numbers of dangerous criminals who continue to avoid appropriate incarceration and are instead released to prey on law-abiding citizens once again. Soros' decision to back and fund candidates running for prosecutor's offices was brilliant. In most cases where candidates he backed won, he unquestionably received a tremendous bang for his buck. Seeing to the election of prosecutor's of a certain idealogical bent has resulted in an unprecedented glut of criminals either totally avoiding any consequences of their criminal activity or being comically undercharged as in this case. | |||

Our main cities (big cities/metros) are turning blue, if not already blue (Dallas proper has been blue for a while). Rest of the state is blood red. Millions of Kali people (liberals) have moved here, into our major cities, making the entire situation much worse. People think Texas and have all these ideas, etc, from the movies or whatever. It’s not 1990’s TX any longer. San Antonio has a lot of Mexican Americans and they’ve been soft on things like this when they need to drop the fucking TX hammer. There are a number of us planning on fleeing the state, for good. We see the changes, and it’s just getting worse. What am I doing? I'm talking to an empty telephone | |||

That’s an incredibly sad story. I remember reading Christopher Reeves book and he was spending $250k a year for health care and that was quite a long time ago. One thing that really struck me was that he said one of the hardest things for him to deal with is the sensory deprivation. He could see his young son at the time laying on him hugging him and if he closed his eyes he wouldn’t have even known he was there. He literally felt like a head propped up on a pillow because the only thing he could feel was when people touched his face. That had to be incredibly difficult. | |||
