Who are you saying is injured? The DWI or a third party? If the DWI, no because they have their own personal responsibility. If third party, yes and DRAM shop suits are filed all the time and should be IF the bar knowingly over served the DWI.

I guess I haven't seen news cause accidents to the extent alcohol does, but anything's possible. A new citation - "Driving under the influence of MSNBC".
