Former Michelle Obama aide, Smollett relative reached out to Kim Foxx

Just days after Jussie Smollett told Chicago police he had fought off a pair of attackers who targeted him in an apparent hate crime, Cook County State’s Attorney Kim Foxx tried to convince Police Supt. Eddie Johnson to turn the investigation over to the FBI.

Foxx’s call to Johnson came after an influential supporter of the “Empire” actor reached out to Foxx personally:

Tina Tchen , a Chicago attorney and former chief of staff for former First Lady Michelle Obama , according to emails and text messages provided by Foxx to the Chicago Sun-Times in response to a public records request.

Tchen passed Foxx’s number to a relative of the actor, and the ensuing conversations with the family member was cited by Foxx last month as the reason she recused herself from Smollett’s prosecution as the actor faces disorderly conduct charges for allegedly making a false police report.

The text messages show Foxx told both Tchen and Smollett’s relative that Foxx had reached out to Johnson personally about handing the investigation off to the FBI.

“Spoke to the superintendent earlier. He is going to make the ask. Trying to figure out logistics. I’ll keep you posted,” Foxx wrote the relative that evening.

“OMG this would be a huge victory,” the relative texted in reply.

Pleading not guilty is standard operating procedure, thereby making the state/government prove its case. It does not mean he’s going to walk, and at this point he has nothing to lose by doing so.

As I have posted earlier from multiple statutes and links supplied everything thing states the threat, coercion, fraud, extortion, etc. must me directed at another individual or another individual’ reputation.
The white powder must be deemed a real and true threat. If you send it to yourself knowing it is not real it does not fall under a real or true threat.

I’d love to see him charged Federally but I have yet to see a statute, granted there are a lot, that this actually falls under. If you have a specific statute please share I would love to be wrong.

Judge Napolitano stated it on Fox News. I'm doubtful he would declare something like that on national media if he wasn't sure about it.

Here's the language for such a violation (18 U.S. Code § 876. Mailing threatening communications), per Cornell Law School:

"Whoever knowingly so deposits or causes to be delivered as aforesaid, any communication with or without a name or designating mark subscribed thereto, addressed to any other person and containing any threat to kidnap any person or any threat to injure the person of the addressee or of another, shall be fined under this title or imprisoned not more than five years, or both."

I'll take their word for it.

And that the charge can be made to stick if they can prove it against whoever crafted and mailed it.
