The problem I see in this world of video cameras is that you can now plainly see that the shots were fired as the perp was turning to leave. I'm sure it didn't seem like that in real time, but the video makes it look bad.

Lag time. It takes some fraction of a second to OODA on both ends, deciding to shoot and deciding to stop shooting. The problem with that is he ran off and didn’t call for help. Running off may have been his best bet, but if they find him he is in some serious hot water.

Not a smart shooting due to the danger to innocents. However.

Use of force statutes vary from state to state but in Florida use of deadly force can be justified to defend yourself or others from imminent death or great bodily harm, or to stop the imminent commission of a forcible felony. An argument could be made that the armed robbery was still in progress and innocents were still in peril and therefore justifiable.

I wonder though whether the shooter was a rival gangster and just happened to be in the drive through. For some reason the folks in the gun car wanted to be gone before the law arrived. Would like to know the outcome.

I really hope that the guy in the drive through isn't a CCW holder. Orange County is one of the few places where you can get one in CA, but I feel that it's hanging by a thread and something like this could get the whole thing shut down.
