That is honestly one of the finest lay explanations of the difficulties with a medical malpractice action that I have ever read. Extremely well stated!
Would you mind e-mailing me your case caption? I'd very much like to read the appellate opinion.

btanchorsThank you all for allowing me to vent on this forum - even 15 years after the fact, it's still cathartic to tell this story. I realized while looking up the information for BurtonRW, we actually settled everything in 2002, not 2001 like I indicated above - so it took 6 years post injury.
Anyway, in an effort to be as balanced as I can, I often wonder how my wife and I would have felt had we NOT pursued this case. I suspect we always would have wondered what would have happened. In a sense, I suspect had we not have pursued it, we would have regretted not pursuing it as well. So it's one of those experiences where there would have been regrets regardless of what you decide.
It all starts with a consultation with a Mal Practice attorney, as others have stated, particularly BurtonRW. If your attorney says you have no case, it ends there, and at least you tried.
As a former boss of mine once said, it's another damn learning experience. Good luck and keep us posted!
