“A Manhattan parking garage attendant who was shot twice while confronting an alleged thief at his business was charged with murder after wrestling away the weapon and using it to fire at the suspect. The nightside worker, Moussa Diarra, 57, was slapped with assault and criminal possession of a weapons charges in the Saturday incident, which occurred at around 5.30am. The attendant saw a man peering into the car windows on the second floor of the West 31st Street garage, reported the New York Post. Thinking that the man was stealing, the attendant brought the suspect outside and asked what was inside his bag. Instead of idling or cooperating, however, the man [Alba, I think] then pulled out a weapon. Diarra lunged for the gun and it went off, leaving him with a stomach wound and an ear graze before he was able to turn the firearms on the alleged thief and shoot him in the chest. …… Last July, it was six days before Alba was let out of jail on Rikers Island and Alvin Bragg dropped the murder charge following a public pressure campaign to do so. Could be that police went cowboy and arrested for multiple crimes and the DA hasn't yet reviewed the case. It's only been a day. Or the facts might turn out that he wrestled the gun away, was holding the perp, there was no longer a threat to good guy and the good guy said, "Fuck it. All the DA is going to do is give the perp a Good Citizen Award and cite me for "Felony Interference with him shooting me." and he took matters into his own hands. IF you keep removing penalties for crimes, people will do more crime. It's pretty simple. It's like capitalism for criminals. If there is a high cost to committing crimes, less people will do it. If the cost is relatively low, but the reward is high more people will do it. Then add to that charging people who defend themselves, it's a recipe for some kind of batman movie. These kinds of arrests make me think right away of "stats". Both men charged and the crime stats or numbers reported show multiple felony arrests. Its a way of scamming crime numbers to make the NYPD look better and to show the public how many arrests they made. It's a BS trick. My department was trying to get a funding increase and in order to justify more money, they changed how we tallied calls for service. Under the former system, a call for service was an actual report or arrest generating incident. With the new system, if the phone rang, it got a call for service stat number. So did traffic stops.
