I doubt it. It seems extremely unlikely that he will be charged. The DA won't take this to a Grand Jury. The DA and Sheriff may put him in for a medal.

As I noted on the previous page, my comment was dripping with sarcasm directed at the conventional Internet wisdom about legal fees following "good shoots".

You have much more experience and insight in this than I, but I was under the impression that all homicides in Texas were presented to a Grand Jury, maybe for possible indictment, a no bill, a standing ovation, or even a direction to the County Judge to make a day in the near future [Shooter]'s Day in the county.

I recall Joe Horn's case.

Much of this misinformation is spread by magazines, internet sites, and hands-on courses dedicated to CCW. They get your attention by scaring you about "what you don't know."

If he is not charged by the grand jury is he completely safe from a civil suit? I'm thinking OJ here. Obviously OJ was tried but found innocent then lost a civil suit.

No. There is no requirement to present all homicides to a grand jury. A prosecutor can decide not to present the case. Joe Horn's case was presented, but the talk was that it was because there was so much political pressure that the prosecutor didn't want to make the decision himself. He didn't take it to the grand jury for months, and the talk was that was to let the political heat for indictment to die down.

MNSIG, I missed the sarcasm, and missed your earlier post.

There is a shield law in Texas, but some commentators believe that the statute should be clarified to explicitly include no-bills and refusals to prosecute so as to better define when a killing is justified, therefore triggering the shield law.

To me, this is a huge issue, and one that Ohio got right. It still surprises me when we are rated low on those "firearm friendly state comparisons" that pop up every year.

Of course, we still have a long way to go to catch Pennsylvania. If I'm not mistaken, you can actually have a drink while armed in a bar there.

In TN you can't carry in establishments defined as bars.

However, if you just happen to have a gun with you and you use it to defend yourself or others you can't be charged.

Stupid way to do business but this way the anti's and the pro 2a both got their wish...

TN does not license bars. Any establishment that serves alcohol must get a majority of their income from food. They just don't enforce the law.

Just heard on the news they will present it to the Grand jury but expect no traction on the case. The shooter also had a fully loaded back up pistol in his pocket.
