New York has declared that NRA’s Carry Guard insurance is “illegal” and is barring residents from acquiring the policies.

Residents who already have Carry Guard policies will see those policies cancel over the next week and a half.

The Times Union reports that approximately 680 New Yorkers currently have Carry Guard policies. Those policies provide “liability insurance for owners who fire their weapons and later face legal charges or claims for damages.”

But the New York Department of Financial Services (DFS) says such insurance is “illegal.” DFS claims a Carry Guard policy “offers coverage even if gun owners were to be found to have broken the law, used unreasonable force, or engaged in ‘intentional wrongdoing.'”

DFS Superintendent Maria Vullo commented, “[New York] will not tolerate conduct by any entity, licensed or otherwise, in contravention of New York Insurance Law, especially when that conduct is such an egregious violation of public policy designed to protect all citizens.”

In addition to canceling all Carry Guard policies in New York, DFS is fining Kansas City-based Lockton Companies $7 million. Lockton is the broker which offered the Carry Guard policies in New York.

It would seem that NYS DFS holds that Lochhart Ins must secure three declinations from primary insurers before they can do it themselves. For each person with the insurance. In addition, it seems the DFS holds that insurance for a criminal charges is wrong. That is pretty stupid as that is not so different from having a lawyer on retainer.

Truly, it is. For quite some time now, I have not considered New York and California to be part of the United States. They've morphed into some kind of insane totalitarian states. They are unrecognizable as being part of this country, and I mean that.

So, do NY auto policies not cover you if you were speeding, making an improper lane change, improper U Turn, failed to use a turn signal, driving without a license etc????

Yes, it's a long been a gun-grabber idea to make owning firearms too expensive. Insure per firearm.

Though, now apparently it's "illegal," so good luck rationalizing forcing firearms owners to buy "insurance" in the future.

Also, how have they pre-determined someone has broken the law prior to any adjudication? The insurance only covers the legal fees. So is the policy only illegal after the trial?

I'm so confused.

Who defines when the action is illegal - before or after the trial and when should the insurance policy become void?

As soon as that DA says "you used excessive force by shooting the bad guy in the chest instead of in the leg" that's a crime?

Is it even legal for a city to declare an insurance police illegal? I would think that unless some industry rules were broken that they wouldn't have a leg to stand on. Lloyd's of London is reputed to be willing to insure just about anything, if the buyer is willing to pay the premium. I don't know that they've ever been declared illegal.

Horse shit. Does car insurance cover you if you, for example, purposely run somebody over with your car? Why would Carry Guard be any different?

Not the city, but the state of New York, and all states have Insurance Commissions and such. As has been mentioned their statement fails to meet the logic test... but that has never stopped politicians and bureaucrats from doing stupid things.
