More briefs were due yesterday in this on-going case which has been returned to the circuit judge post Bruen.

The judge asked for the parties to cite relevant historical laws. In support of the AWB, the State of CA, submitted a Kentucky law that "Prohibited “negro, mulatto, or Indian” from possessing or carrying a gun, powder, shot, club, or other weapon or ammunition." This is one of several such blatantly racist laws cited from the late 1700's to support a current AWB.

Amazing to me that this is among the arguments the State AG is going with.

There is a lot of optimism regarding this case, as well as a separate case the deals with the magazine capacity restrictions.

From what I gather, the parties have two weeks to respond to the briefs submitted and then the matter goes to Judge for a decision. It seems clear to all that Benitez will rule, again, in favor of the 2A... Even Newsom stated recently that the AWB will be struck down in the coming weeks.

The conjecture is what will the 9th do with it? Being the 9th it is historically wise to assume the worst, but there is a lot of speculation that post-Bruen the 9th will have a far harder time trying to undo the decision by the circuit judge.

May have further good news in the next 4-6 weeks!

If the state appeals, the Ninth Circuit will have to uphold the Benitez ruling being consistent with Bruen. That means the entire Ninth Circuit would be subject to the ruling, so WA and HI, not just CA. I hope I understood that correctly.

That would be nice, but one would have thought that the ninth circus would have had to uphold his decision on the magazine ban, though that is not looking likely. I just hope the composition of SCOTUS doesn’t change unfavorably before these two cases get there and that SCOTUS gives the ninth circus the smackdown that it so richly deserves.

You did read it correctly...that's why some folks were thinking that CA wouldn't take it before the 9th Circuit
