Sitting up in my Oak, he flew right in, looking for mice or rabbits, small critters... Sat long enough for me to snap a quick ifone picture.

I'm guessing it is a red-shouldered hawk. These guys are similar to other hawks so I'm not 100% positive.

I agree red shouldered hawk. We have a pair show up here every year to hatch and raise a baby-pretty impressive to watch. Gets pretty noisy when they are teaching the baby to fly and to hunt, though. We welcome them for rodent and snake control
