6th Amendment: "In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence." Impeachment is not a criminal prosecution, it is a political act. The trial in the Senate is not a "trial" in the sense that a criminal proceeding is a trial. The impeachment and subsequent impeachment trial takes place in the House of Representatives and the Senate, not the "State and district wherein the crime shall have been committed." Impeachment need not be for a crime, for example, it can be for breach of a duty, or abuse of power. Double jeopardy does not apply; someone who is impeached and convicted can later be subject to indictment and criminal trial for the same conduct and set of facts. The President can pardon a criminal sentence, or commute a criminal sentence, but can't pardon an impeachment or reinstate in office one who has been impeached and barred. So, in short, the 6th doesn't apply to any part of the impeachment process. I don't want to rain on anyone's parade, but the Democrats aren't violating the Constitution by what they are doing. I believe, however, that they are committing a very serious political mistake in permitting their desire to damage the President override any sense of fairness in the process. I think that most ordinary voters will be seriously turned off by their tactics, and offended by their conduct. The fact that impeachment is a political process does cut both ways. While you can get away with things you can't do in a criminal trial, you still must conduct the process in a way that the public perceives as transparent and fair, or they will reject the result. This is what I keep hearing. An impeachment is a "political matter." The normal rules of fair play do not apply. You can't truly call yourself "peaceful" unless you are capable of great violence. It doesn't given its a political proceeding. But where it 'does' matter is with public support.
