ZSMICHAELNevada officer pulls over hearse traveling in HOV lane
I guess dead guys don't count. I do recall that the guy traveling with the inflatable sex doll got pulled over. Come on Vegas! I guess you can really be late for your own funeral.
Nevada Highway Patrol says the hearse driver assumed the body in the back counted toward the two or more occupant requirement for the lane.
LAS VEGAS — Nevada Highway Patrol says passengers must be alive in order to be counted as occupants in cars using the high occupancy vehicle lane.
The reminder was prompted by a traffic stop Monday involving a hearse traveling on the carpool lane on Interstate 15 in Las Vegas.
A trooper pulled over the hearse that was transporting a dead body.
The agency says the hearse driver assumed the body in the back counted toward the two or more occupant requirement for the lane.

Would this be what they call a "cold case?"
If I were a judge hearing the case, I'd want to hear testimony from all parties.

comet24If I was a cop no way would I write that ticket. Talk about some bad karma and I don't believe in that stuff.

FlashlightboyI would have written that ticket all day, everyday.
The purpose of the HOV program is to get people - drivers - out of their cars into a multi driver car that takes a car off the road.
The corpse wasn't a qualifying driver or person. If you think it was, then you'll to give a pass to someone carrying someone's ashes or a fetus in the womb.
I once prosecuted a HOV ticket for the CHP and the lady's defense was that she was a Christian and her unborn child was a person and that allowed her to use the HOV lane. She was dead serious and had sorta cult trance in her eye.
Quick thinking me piped up and asked if that was sufficient admission for the CHP to write a ticket for having the child in an unapproved child seat and both the judge and CHP thought it was.
Stunned that she wasn't going to walk away, she accepted the $400 HOV ticket and paid it.
The hearse ticket was a good ticket.

I'm with you on that. I will take it a step further and make it a requirement for the passenger to be a license holder. That precious newborn or toddler is not gonna cut it, since they can't drive anyway.

YooperSigsI used to be in the corpse delivery biz. Recession proof occupation! Stiffs are not chatty and make dull traveling companions. Since I wanted to spend as little time with the departed as possible, I mostly ignored the posted limits. I was stopped from time to time (often by Kentucky SP) and the trooper always wanted to know what I was hauling.
When I told him, I was immediately kicked loose, ticket free.
Everyone understood that the less time spent with my passenger was a good thing for all involved!

FlashlightboyI don't wear a badge. I was in the DA's office working for them.
People use all kinds of excuses to use the HOV lane. The hearse driver was trying to get away with a ticket.

2000Z-71Then there was the Arizona case a few years back where a pregnant woman claimed to qualify as 2 occupants. The judge didn't;t see it that way...

This is quite fascinating to me since Scott Peterson is doing time for 2 murders.

casMy response is... what does the law say?
(I live in a state with intentionally vague laws about almost everything)
