As I understand it:
a) the Democrats (in the Senate) are in favor of the renewal and want the House to pass the renewal so they can send it to FJB, but
b) the Democrats (in the House) are against it...so much so that it would take almost every Republican to vote for it, but, not withstanding a) and b)...
c) the theory is that it's the Republicans who are confused?!?!

I'm missing something fundamental here.

^^^Technically, it was a procedural vote on the rules to move the bill to the floor of the house, NOT a vote for or against the FISA re-authorization. The Democrats in the House are likely all for re-authorizing FISA exactly as it's currently written, as are the Democrats in the Senate. They were only voting against the procedural vote as the don't have any control with respect to the rules, essentially a Parliamentary Protest Vote. It's kinda stupid, though it's apparently an acceptable practice, and expected of the minority!

While 19 Conservatives voted against, 'some' conservatives (MTG, Jim Jordan & Thomas Massie to name just a few), voted in favor so as to move the bill to the floor where 'certain' amendments would/could be voted on, such as to require the FBI to obtain a Warrant in order to surveil/gather intel on American Citizens. This is merely an example of how dysfunctional congress is, especially the Rules Committee and the way it operates.

I would seem that both groups; the 19 Conservatives that voted against and certain other Conservatives that voted in favor, all want the same thing, which is to eliminate Warrantless Surveillance of American Citizens, the difference being how they get there. Though some wanted guarantees, it seems everyone's rolling the dice here. Unfortunately, it would appear that the Speaker, by his actions, is NOT part of either group!

Many people have been misled today.

There was not a vote on the FISA bill.

There was a vote on a resolution that would have allowed FISA, as well as 6 amendments to it, including a warrant requirement amendment, and three other pieces of legislation to come to the floor.

On partisan procedural votes like this, Democrats reflexively vote no and Republicans typically vote yes.

19 Republicans voted with all the Democrats to stop everything from coming to the floor today, including the warrant amendment to FISA.

Many of us who are adamantly opposed to warrantless surveillance voted for the resolution, wanting to get a recorded vote on warrants, and recognizing the Speaker can otherwise suspend the rules and bring anything to the floor without a resolution, like he did with the omnibus.

Tactically, whether the 19 did the best thing or not is TBD.

They may have just stopped our only chance to have a vote on whether the government needs a warrant to spy on you.
That vote might not have passed, but everyone would have had to go on the record for the world to see.

So what we had was a difference of tactics, with members like Jim Jordan, MTG, Warren Davidson, myself, and other defenders of the Constitution parting ways with those who saw an opportunity to temporarily throw a wrench in things by voting with Nancy Pelosi and Adam Schiff.

Now that the rules resolution for the bill + amendments has failed, the swamp could:

1) suspend the rules to pass a worse FISA

2) make concessions and improve the rules for the bill

3) say they don’t need a new bill to keep FISA going, or

4) let the senate move first on FISA

Pretty much describes the vote yesterday. It was not the final vote; bills go through the House starting in committees, then committee votes, a procedural vote, back to committee, back to procedural vote, some more tweaking of the bill, then a final vote. The House has been working on this since last year; in fact, they extended the current FISA in Dec., kicking the can down the road so to speak. And the Republicans only have 7 days left to finalize this.

The big reason why all of the Democrats voted NO has nothing to do with patriotic reasons. If this renewal bill, with 56 Republican provisions (and quite possibly more added by Jim Jordan and his Judiciary Committee)) does not get out of the House by April 19th, it is dead in the water. But there are two choices left- first a quick HOuse vote to extend the present FISA another year with no provisions or amendments. The other choice is to go with the Senate's version of the FISA renewal, which apparently Biden and Democrats are counting on. The Democrat controlled Senate has a renewal that apparently at best is like the present one, and at worst, a more watered down version.

The House has put a modified surveillance bill on track for final passage as soon as Friday, just days after an earlier version failed to advance in a public rebuke to GOP leadership.

The House voted Friday morning to approve the rule governing debate surrounding the modified bill behind Foreign Intelligence Surveillance Act reauthorization, a key step before final passage. The procedural vote was 213-208 along party lines.

The advancement of the legislation is a win for House Speaker Mike Johnson – after GOP leadership’s defeat on the floor just two days ago – and comes as the Louisiana Republican faces direct challenges to his leadership. GOP Rep. Marjorie Taylor Greene of Georgia filed a resolution last month that could force a vote to remove Johnson from the speakership, and Greene has been citing that threat to escalate pressure on Johnson over issues such as changes to the FISA reauthorization and aid to Ukraine.

The new version of the FISA bill would be a two-year reauthorization instead of five years, meaning that if former President Donald Trump won the presidential election this year, the legislation would be up in time for Trump to overhaul FISA laws next time around. That change helped appease the conservative House members who originally opposed the bill, sinking it Wednesday.

Johnson organized a classified reading room off the House floor for members to view classified information ahead of Friday’s vote, according to a GOP leadership aide.

Johnson is also scheduled to meet with Trump in Florida later Friday.

Biggs' FISA Warrant Amendment Fails In Tie Vote

Update (1245ET): The 'Biggs' amendment, which would have required warrants as part of FISA, has failed following a tied vote of 212-212.

Section 702 of FISA allows for the warrantless surveillance of foreigners outside of the US - which allows the government to sweep up communications from Americans who are interacting with individuals who are being spied on.

The 'Biggs Amendment' would add a warrant requirement before the government can review information collected on Americans.
