Earlier this week, the Lemkin Institute for Genocide Prevention and Human Security issued a haunting warning. Dr. Elisa von Joeden-Forgey, president of the Lemkin Institute, stated that the U.S. is in the “early-to-mid stages of a genocidal process against trans and nonbinary and intersex people.” Dr. Gregory Santon, former president of the International Association of Genocide Scholars, flags “a hardening of categories” surrounding gender in a “totalitarian” way.
Stanton argues that this is rooted in Nazi ideology’s surrounding gender — this same regime that killed many LGBTQIA individuals in the name of a natural “binary.” As Von Joeden-Forgey said, the queer community, alongside other “minority groups, tends to be a kind of canary in the coal mine.”
In his first year in office, Trump and his Cabinet’s anti-trans rhetoric has only intensified, with a report released late September by journalist Ken Klippenstein in which national security officers leaked that the FBI is planning to classify trans people as “extremists.” By classifying trans people as “Nihilistic Violent Extremists,” far-right groups would have more “political (and media) cover,” as Abby Monteil reports for them, for anti-trans violence and legislation.
While the news is terrifying, it’s not unprecedented – the fight against trans rights and classification of trans people as violent extremists was included in Project 2025, and in the past several weeks, far-right leaders’ transphobic campaign has expanded: boycotting Netflix to pressure the platform to remove trans characters, leveraging anti-trans attack ads in the Virginia governor’s race and banning professors from acknowledging that trans people exist. In fact last month, two Republican members of Congress called for the institutionalization of trans people.

Jury Finds Doctors Liable for Malpractice in Gender Surgery Lawsuit
A jury awarded $2 million in damages to a 22-year-woman who underwent breast removal surgery as a teenager.
WHITE PLAINS, N.Y.—A jury on Jan. 30 found a psychologist and surgeon liable for malpractice after they supported and performed breast removal surgery on a 16-year-old girl who at the time identified as transgender.
Fox Varian, now 22 and no longer identifying as transgender, was awarded $2 million in damages, with $1.6 million for past and future pain and suffering, and another $400,000 for future medical expenses.
The jury found that in many respects the surgeon and psychologist had skipped important steps when evaluating whether she should go forward with the surgery and had not adequately communicated with each other. These missteps were a “departure from the standard of care,” they decided.
During closing arguments, Varian’s attorney Adam Deutsch had asked the jury for $8 million in damages. To justify that sum, he quoted earlier testimony where Varian described her reaction to seeing her post-surgery chest.
“I immediately had a thought that this was wrong, and it couldn’t be true,” Varian said. She also said that the surgery left her with nerve pain, which she described as “searing hot ... ripping sensations across my chest.”
“Shame. I felt shame,” she added. “It’s hard to face that you are disfigured for life.”
Varian wept and hugged her mother and attorney following the verdict, which concluded a three-week civil trial at the state Supreme Court in Westchester County.
“A jury of everyday Americans sent a clear message: justice will be served for vulnerable individuals who were misled into gender-transition procedures without appropriate safeguards,” said Josh Payne of the firm Campbell Miller Payne, who was not involved in the case but was in court observing Friday’s proceedings. His firm was founded three years ago to represent plaintiffs in cases similar to Varian’s.
The decision came after the young woman regretted the 2019 surgery and sued psychologist Dr. Kenneth Einhorn, surgeon Dr. Simon Chin, and their respective employers.
The six-member jury was not asked whether gender-related surgical procedures are appropriate for minors. The question was whether the therapist and doctor took the appropriate steps before the surgery was performed.
Varian’s attorney argued the healthcare professionals did not correctly diagnose and treat her for gender dysphoria—distress and anguish caused by a mismatch between one’s physical sex and their internal perception of their gender.
Chin and Einhorn’s attorneys argued that Varian did not express regret for the surgery until years later, when she filed the suit in 2023. They noted that she told Einhorn, Chin, and her mother that she was “happy” with the results, and continued to live as either male or non-binary for years after the procedure.
Neil Kornfeld, who represented Einhorn, read from an essay Varian wrote 10 months after the surgery to back up their claim.
“It’s such an immense relief to wake up and not feel at odds with my body,” she said at that time. On the witness stand, Varian said such comments came from “cognitive dissonance” as she tried to put on a brave face about her inner turmoil.
In October 2019, Einhorn wrote a referral letter to Chin supporting Varian’s decision to have the chest surgery; she had first brought up the idea to him in March that same year. Varian’s attorneys said that since the letter contained some omissions and inaccuracies, Chin didn’t have a clear picture of his patient’s psychological history.
Trial evidence showed that Einhorn didn’t have the full picture either.
Before the surgery, Varian had told staff at the Albany Pride Center that she felt she “felt pressure to decide” on a male identity or a female identity “by family, friends, and culture.” She also said she continued to question her gender identity, but was afraid she might “lose credibility” if she brought it up with her mother.
Einhorn said he might not have written the letter had he known; Chin also testified that had he known Varian was unsure of her gender identity, he would not have performed the surgery. Deutsch said Einhorn should have reached out to Albany Pride Center for records of her time there; he also said Chin and Einhorn should have communicated with each other, at least once, by phone call.
He began the trial by suggesting that Einhorn “drove the train” and had been “putting ideas in Fox’s head” during attempts to change her gender.
But defense attorneys argued that Varian, not Einhorn, had spurred decisions like using “he/him” pronouns, cutting her hair short, and changing her name from Isabelle to Gabriel, then Rowan, then Fox. They said the decision to wear a chest binder, and later the breast removal, were also her idea.
Deutsch, in his closing statements, said that was the problem, describing Einhorn’s attitude as “Whatever the kid wants, the kid gets.”
Varian’s mother, Claire Deacon, testified that she was against the surgery, but consented out of fear her daughter would commit suicide if she didn’t get it. Einhorn increased that worry, she told the court. Defense attorneys countered that Varian had made similar threats on multiple occasions, and that ideas of self-harm didn’t come from her therapist.
Both sides of the case have declined to comment.

I guess that’s good. If the doctor are terrified of losing their shirts (and or their licenses) perhaps they’ll stop offering the drugs and the surgery. Perhaps if it got to the point where patients had to sign involved contracts forever indemnifying the doctors against liability the patients might think twice. Small problem - in what states can a minor sign a legal contract binding themselves in adulthood?
I can’t help wondering where in the world were the parents in all this though. If your child wanted to mutilate themselves would you support it?

Major Medical Group Announces Opposition to Pediatric Transgender Surgeries
The available evidence requires ‘a precautionary approach,’ the American Society of Plastic Surgeons said.
A group representing plastic surgeons primarily in America and Canada on Feb. 3 said it opposes carrying out breast removal and other gender transition surgeries on minors.
The American Society of Plastic Surgeons (ASPS) told members in a 9-page statement outlining its position that there is insufficient evidence supporting a favorable risk-benefit calculus for performing the surgeries on children. “ASPS recommends that surgeons delay gender-related breast/chest, genital, and facial surgery until a patient is at least 19 years old,” the group, which represents more than 1,000 doctors around the world, many of whom are based in the United States or Canada, stated.
ASPS in 2019 had said states should not restrict the surgeries for children experiencing gender dysphoria, or the belief that they are a different gender from their birth sex. In 2024, the organization said there was “considerable uncertainty as to the long-term efficacy for the use of chest and genital surgical interventions for the treatment of adolescents with gender dysphoria” and that it was reviewing the available evidence.
The new position stems in part from recent reports and papers summarizing the available evidence, including a 2025 report from the U.S. Department of Health and Human Services that found little evidence supporting the so-called “gender-affirming” surgeries. Officials at the time said therapy was the preferred approach for the children in question. That report highlights how some children who report that they are suffering from gender dysphoria eventually improve without surgery, emphasizing the need for “a precautionary approach,” ASPS said on Tuesday.
An estimated 3,678 minors in the United States underwent surgical procedures such as breast removal from 2016 to 2020, according to a 2023 study by physicians at Columbia University and the University of Southern California. U.S. health officials hailed the new development.
“We commend the American Society of Plastic Surgeons for standing up to the overmedicalization lobby and defending sound science,” Health Secretary Robert F. Kennedy Jr. said in a statement. “By taking this stand, they are helping protect future generations of American children from irreversible harm.”
“When the medical ethics textbooks of the future are written, they’ll look back on sex-rejecting procedures for minors the way we look back on lobotomies,” Centers for Medicare & Medicaid Administrator Dr. Mehmet Oz said. “I applaud the American Society of Plastic Surgeons for placing itself on the right side of history by opposing these dangerous, unscientific experiments.”
Dr. Stanley Goldfarb, chairman of Do No Harm, a group that opposes gender-reassignment surgeries for minors, said in a separate statement that ASPS was “the first major medical organization to support evidence-based and ethical medicine and reject, in their words, these harmful and irreversible procedures.”
The American Academy of Pediatrics is among other medical groups that support performing the surgeries on children if certain criteria are met.
“The American Academy of Pediatrics remains committed to ensuring that all children—including gender-diverse youth and children covered by Medicaid—receive care that is backed by science, delivered with compassion, and offered without political interference,” Dr. Susan Kressly, at the time the organization’s president, said in a statement in late 2025.
