In a 8-1 ruling today, the WA Supreme Court rules in favor of the Seattle gun and ammo tax. $25.00 per gun purchase and up to .05 cent per bullet. The court said this tax was NOT regulation. I beg to differ. And these taxes could go up in the future too. Other cities around Seattle could apply their tax also. So at what level does a tax become a regulation $100, $1000, $10,000. In my mind, any type of goverment imposed hurdle is a defacto regulation since it imposes an obstacle to freedom. I guess I would make a lousy activist judge. Ken | |||

I remember Daniel Patrick Moynihan proclaiming from the Senate floor that if we can't "ban guns and ammo, we will tax them out of existence." You couldn't pay me to go to Seattle. They mailed me the check. I haven't smelled human waste since I was last in West Seattle. It's Seattle let them define themselves anyway they chose. I've strongly suspected that the real motivation behind Seattle's "gun violence" tax was not to raise tax revenue, but to win a state Supreme Court decision which would allow other cities in Washington to impose "gun violence" taxes. | |||

I'm ok with it. Seattle spent more defending than they have collected. It is still a success in their book though as it achieved the real puroose, drive gun business out of the city. No sales tax on mail order, so no effect. I'm not too concerned about it spreading to other cities as the liberal loonies are pretty localized. Other cities are less willing to loose the other revenues of driving businesses out of town by pushing an agenda. As much as I would love to support local businesses, I am on a limited income and need to spend wisely. Most areas on west side of the state are now 10% plus sales tax (and every couple years they still try to drum up support for income tax). For guns, brick and mortar stores are $50-$100 over online prices, put another 10-10.3% sales tax on that and I will pay the transfer fee and keep the extra $125 in my pocket. State try's to push FFL to collect sales tax on transfers, but many still don't. I am 5-7 years from retirement and can't wait to see this state in the rear view as I leave... What part of "...Shall not be infringed" don't you understand??? | |||

Not sure of the history of this case, but it wasn't brought as a 2A case. It was simply an interpretation of a state statute that hinged on the definition of a tax vs. a regulation. I don't see anything in the opinion that is egregiously erroneous from a legal point of view. I am curious why this wasn't attacked on constitutional grounds in federal court - the tax is basically a 25% levy on ammunition, which seems like it could have problems passing muster. | |||
