Transferring my home gunsmithing business to FL. Anything I should know?

benny6Transferring my home gunsmithing business to FL. Anything I should know?
So I'm moving in June to FL. Somewhere on the outskirts of Orlando. I'm trying to find specifics for FL's requirements to have a home FFL or home gunsmith business, but I can't find anything.
Some people on other forums have said I have to have a storefront to have a FFL. Does anyone know if that's true? I can't find and answer and I'm sure it's FL specific, not a federal requirement.
TIA,
Tony.

To the best of my knowledge, this is
not a Florida state requirement. I know that there are, or at least were fairly recently, some "kitchen table" FFLs.
You might find some zoning restrictions on the municipal level. For example, it would be a problem for me to run a home-based business that allowed customers to come to me. Mail order type business would not be a problem where I live; this is local rule, not state regulation.

Sig2340There is no federal requirement to have a storefront.
The feds do, however, require you operate within all federal, state, and local laws, including zoning rules and any restrictive covenants in a Home Owners Association.
I seriously doubt there is a state requirement for a storefront. Whether there is one at the local level, that you need to research.

This is true, there is no state requirement or ATF requirement. There are the standards security measure requirements though. I ran my FFL out of my house, but my agent said if he found one 4473 from foot traffic he would revoke my license as it went against county zoning.

Means I better not have any 4473’s that weren’t in the name of someone who lived in that house!
4473’s must be in person and can’t have foot traffic so…
He was a really nice guy but was adamant that the ATF wanted you to abide by all state and local laws as well.

PPinesRonSearch the MyFlorida website. Might have your answer, but most probably lead you to the folks that could answer your question(s).

Is that not a bit presumptuous? Could you not have set up a booth at a local gun show or elsewhere that would have generated in person 4473s that do not include foot traffic to your home?

92LX,
Short answer is, I think the man was very casually trying to tell me don’t break any local zoning rules.
Long answer is, yeah, there are probably a few ways I could have generated a 4473.

SIGfourmeType 01 is the "kitchen "table FFL. To sell and transfer guns. You need to talk to local LE.
Type 07 is manufacture of firearms. Zoning regs come in to play. You need to discuss with local LE and zoning.

benny6Thanks guys. I'm also having out realtor look into it.
If we go with a HOA, they have to sign off on it. My current home was a new construction and the builder was the HOA, so they rubber stamped my approval.
As added insurance, I became the HOA president.
The fact that I'm not a storefront shouldn't make it a problem. I think we're looking at Polk and Osceola county, so I will probably have to contact the county offices to find out zoning regs.
Very complicated at times.
Thanks for the help.

You shouldn't have an issue, other than any HOA rules that come up preventing you from operating something within the HOA, be sure to read the HOA covenants before buying the property.
Plenty of home based FFL's in Florida..

Type 01 FFL is for engaging in the
business of dealing guns and gunsmithing. (That could be a home-based "kitchen table" FFL, but it's also the same type of FFL held by many gun stores.)
Anytime you're running a business from your home, of any type, HOA/zoning rules may apply. Therefore, you need to check local zoning laws and HOA covenants, even for a 01 FFL.

on the 4473, near where you put the DL info etc, is a block, don't recall the number, for you to put the location you are at, as in event and city/state, that is for gunshows

if you have a FFL now, it will be the same process as you had to go thru but in Florida
either way, contact the ATF, as in a local field office in Fla close to where you are moving and simply ask them,
since I would make the assumption you are going to have a business license, you may want to enquire with the county or city about any hoops for gun related business,
as well as ask the ATF if you need any state licensing
