The Second Amendment doesn't grant shit. It tells the fucking asshole government to keep their grubby hands off, and to fuck off. ARman

Yes Smerconish is a douchebag and no on line polls dont matter. But it still would be nice to turn this poll on it's head and give them a result they don't expect.

Yes but, the militia is: (a) The militia of the United States consists of all able-bodied males at least 17 years of age and, except as provided in section 313 of title 32, under 45 years of age who are, or who have made a declaration of intention to become, citizens of the United States and of female citizens of the United States who are members of the National Guard. (b) The classes of the militia are— (1) the organized militia, which consists of the National Guard and the Naval Militia; and (2) the unorganized militia, which consists of the members of the militia who are not members of the National Guard or the Naval Militia. 10 USC s. 246

Peace through superior firepower |
You can bet your bottom dollar that only a very small fraction of those voting in that useless poll could even begin to articulate their position on the matter. Therefore, the poll is meaningless. All they know is "guns are bad and kill people by themselves so we need to get rid of guns." Don't waste your time. Who cares what that poll says? It is meaningless. And for the record, the Second Amendment doesn't "grant" anything, militia or otherwise. The wording of the amendment tells you; "...the right to keep and bear arms shall not be infringed." The Amendment acknowledges the right to keep and bear arms as a pre-existing right, and it is one of those unalienable rights mentioned in the Declaration of Independence. In a million years, those puking little commies would never be able to divine this.

Not that it matters much with a poll in such useless location, but I tried to click Yes, and it wouldn't take it. I tried 4 different browsers. How convenient. ________________________________________ -- Fear is the mind-killer. Fear is the little-death that brings total obliteration. I will face my fear. I like asking commies that offer the militia as the reason for the amendment why a government would feel the need to protect it's right to arm itself. There are no governments anywhere in the history of the world that felt they needed to codify their access to arms. Calgary Shooting Centre

Well, it's not exactly an unbiased poll, so … This jerkoff, whoever he is, is taking a poll from his own readers. Such results are to be expected.

Mortal men are unable to grant fundamental rights to other men. This is a divine attribute; solely. (That doesn’t mean they don’t seek to restrict their exercise all the damn time.) At best, men show reciprocity out of respect or consequences. Governments must seize wealth before they redistribute it as well. They are not prudent unbiased guardians of either rights or money. Well trained chefs, being necessary to a healthy happy society, the right of the people to own and use cooking implements shall not be infringed. Skilled journalists, being necessary to a well informed populace, the right of the people to own and read books shall not be restricted in any way by the government. Would only chefs be allowed to own spatulas and mixing bowls? Would only journalists be allowed to read books? All it takes is a little bit of thoughtful analysis to see that the operative clause says what the right is, who has that right, and how the government may restrict it. The prefatory clause just says why that right is important and why it is being written out. It does not alter the meanings of the words in the operative clause, e.g. the word people is not changed from its plain meaning to only referring to a particular sub group.

As Antonin Scalia pointed out (I think in the Heller decision), there is no where in the Constitution where the term "the right of the people.." is used, where it does not confer a direct individual right to the citizens of the United States.

Go back to the times the Constitution and Bill of Rights were written. The Militia was the average ordinary Joe. See the men responded to the British operation at Lexington and Concord for greater definition. They were ordinary citizens defending their towns and homes.
