San Jose to tax gun owners yearly
The San Jose City Council voted this in last night (Tuesday). A yearly tax on owners, requirement of insurance, and non-compliance will result in confiscation by city.

I highly doubt it would survive scrutiny by SCOTUS.

This is just a good way to keep the Second Amendment Foundation, et. al, attorney's funded. There's no way this will survive, probably even at the 9th Circuit level, ending this without even going to SCOTUS.

We should strip away any government budgeted protection service they receive - armed guards, escorts, whatever. If they get any service, they should be taxed on the benefit. The public pays for the wages, expenses, insurance etc for the employees providing security services. That benefit should be applied as personal tax to the government employee benefitting from said service. Any level up to the POTUS. Cost of SS detail - cost should be added to POTUS as income and be personally taxable.

I don't know. I'm making stupid shit up. Just like San Jose.

Won't even leave the state....

Much like what SF attempted to do years ago with a rash of young but ideologically bent 'progressives' on the board of supervisors, they passed a variety of 'good idea' gun laws and snuck a handgun ban onto the ballot. Most of them got shot down by the courts as being unconstitutional.

Chuck Michel will likely lead the defense team and the City of San Jose will be paying through their nose on these.

It is not a poll tax, but it will be unconstitutional.

Call it anything that you want to as long as you realize that when the courts get involved that if it was applied to me that I would go after the people personally that tried to enforce this unconstitutional action. Commiefornia at its best. ............................ drill sgt.

Predictions:

1. Lawsuit(s) will be filed
2. Injunctions will be issued suspending enforcement until court action is finalized
3. Measure will be overturned by the courts
4. TAXPAYERS WILL PAY EVERY STINKING DIME OF LEGAL EXPENSES AND COURT COSTS FOR BOTH SIDES OF THE ACTIONS.

#4 is the really big problem with such nonsense. The politicians never have to come up with the money to pay for their mistakes, everything is passed on to the general public.

Nothing yet....but, over in Chicago a similar fight has been in the works

Chicago reinstates gun and ammunition tax after court deems it unconstitutional
quote:
he Cook County Board of Commissioners reinstated its firearm and ammunition tax after it was struck down by the Illinois Supreme Court in October.

During Thursday's board of commissioners meeting, members voted to approve an amendment to a previous ordinance dealing with how firearms and ammunition are taxed in order to comply with an Oct. 21 Illinois Supreme Court ruling.

The Oct. 21 opinion struck down the tax because it impeded on citizen's Second Amendment rights. However, Illinois Supreme Court Justice Mary Jane Theis said in the court's opinion that any tax on fundamental rights must "establish that the tax classification is substantially related to the object of the legislation."

The new amendment passed by the board of commissioners directs revenue raised from the tax to a new "Special Purpose Equity Fund to fund gun violence prevention programs." Revenue from the tax will also go to "operations and programs aimed at reducing gun violence."

Previously, the revenue went toward a "Public Safety Fund to fund operations related to public safety."

Under the ordinance, retail purchases are subject to a $25 tax for each firearm purchased. Centerfire ammunition is taxed at $0.05 per cartridge, and rimfire ammunition is taxed at $0.01 per cartridge.

The board voted to tax firearms in 2012 and amended the tax in 2015 to include ammunition.

According to the Chicago Tribune, Cook County Board President Toni Preckwinkle believes the revisions made to the ordinance will align it with the court's opinion.

Preckwinkle cited gun violence statistics when asked why she wanted to save the tax.

"The cost of a bullet should reflect, even if just a little bit, the cost of the violence that ultimately is not possible without the bullet," Preckwinkle said.

One Republican commissioner, Sean Morrison, told the Tribune the measure is still unconstitutional, even with the revision.

In their mind, it's throwing as much against the wall as possible and seeing what sticks. With all forms of media, news and entertainment firmly on the side of the Left, they're banking on shaping public opinion while pushing such measures.

What strikes me as most interesting is that the city council voted strongly to support the measures, despite seeming to have no clear support from the community- essentially deciding what they want for the city. It also clearly violates California law that stipulates that no lesser body of the state can enact more stringent measures than the state constitution allows. The leftists attacking our rights couldn’t be more obvious.
