I'm not trying to get into a pissing contest with you.

I am simply asking how you can impose a greater penalty than that prescribed by the law which you are paid to enforce.

"The $25 fine is not the only penalty that can be imposed..."

This implies that you can impose a different or even a greater penalty than that specified in the law. From where do you get the authority to apply this extra-lawful penalty? That's all I'm asking.

Ok, this is it for me. I will try to explain this one more time. A penalty can be more than just monetary, it can be a "probable cause search", a detainment for "other reasons" or anything else along these lines, and as I stated before, 99.9% of the time it is usually a warning and "Have a nice day". You actually should be thankful that the letter of the law is not always carried out as written or you and everyone else would have more speeding tickets, vehicle safety violation tickets, noise ordinance violoations, etc... than you can count.

I don't think he is saying that he could or would impose a greater penalty then what the law says.

What he is saying, if I understand correctly, is if someone acts like a tool or wannebe lawyer then he (like most LEOs) is going to take the time and effort to be a hard ass.

Come on, really? Your asking on a public website if you should break the law?
Not gonna post my opinion about what you should do, your decision. Just gonna state you left your permit behind on a trip? Must be the military in me but that is a major fault on your part. My permit is a "must have" on any trip I take. Visual confirmation as it is packed for travel.

I was in the military too. accidents happen. I had a lot of other stuff to pack and forgot i was in the middle of changing over wallets.

its a non criminal $25 fine if i get caught. I dont plan on getting caught. My life is worth $25. I can keep it in the glove box legally without it anyway.

the point of the question was to see what other forum members would do in my situation.

No offense taken. I understand where you are coming from having to leave your weapon at home. I drive my HS student son every am and have to leave it behind until I get back.
