I have a coworker who is moving from Arkansas to Florida and has a silencer.
What does he need to do to get his silencer here legally? www.joshua-davis.com/ The Free State Project "If somebody says there ought to be a law there probably ought not." - Penn Jillette |

He should notify BATFE of change of address. I am not sure what specific form is needed. Since he his moving from one silencer friendly to state to another, there should not be a problem at all.

Here you go Form 5320.20 in PDF format directly from the ATF website.

I've seen this topic here before and others who are much more in the know than I have said that supressors do not fall into any category for notifying the BATFE regarding a change in address.
My understanding is that firearms that are covered by the NFA rules do need the Form 5320, but not suppressors. It would be worth your while, though, to search the board for similar situations to yours for additional information. |

Marksman41 is correct, you don't need to fill out a Form 5320.20 for a suppressor. See item a in the instructions on the form.
"a. A written request and prior authorization from ATF to transport interstate or in foreign commerce any destructive device, machinegun, short-barreled rifle, or short-barreled shotgun is required under the provisions of Section 922 (a)(4), Title 18, U.S.C., and Section 478.28, Title 27, CFR, a letter of request, in duplicate, containing all information required on this form, may be submitted in lieu of the form. Note that suppressors are not mentioned. -------------------------------------------- Loyalty Above All Else, Except Honor |

suppressors are exempt from filing for temporary moves but required for permanent moves of any NFA. File the form and check the box for permanent. Be aware that any subsequent transfers(should you sell) will be mailed to the address of record not the one on the form. That means your form 4 when you sell will go to the old address which might be bad and at the minimum will delay the transfer.

I don't think that is correct about the change of address. If you notify them in writing of the change of address, they will send you a copy and notification that they received it and made the change in the registry.
They will not mail any new form 4 transfer back to the old address. When you fill out a form 4 on sale etc, you will put your current address in line 3a and the approved form will be mailed back there. |

Notify change of address by mail, they'll mail you a confirmation a few months later.
You can take the items there immediately. It's also a good idea to call to confirm the change of address, and keep the returned confirmation letter in a safe deposit box... ...for when the NFRTR shows no info on you, and you have the only info that you are compliant with the law. ___________________________________________________________ So the Libyan Fable is told That once an eagle, stricken with a dart, Said, when he saw the fashion of the shaft, "With our own feathers, not by others’ hands, Are we now smitten." -Anton Myrer, "Once an Eagle" |
